When I opened my account with Compass Bank several months ago I was asked ONE question, "Do you want to opt in or out of overdraft protection?" I said opt OUT, and on my contract it clearly shows I opted OUT. A couple of weeks ago an automatic payment was charged to my account and overdrafted it by $440!! This clearly should not have been done when I opted OUT of overdraft. One top of that they charged me fees totaling over $150! When I called to find out why the charges were posted the lady told me that I opted out of one ONE overdraft protection but not the other. I clearly told her that I was only given ONE option and she verified on my contarct that it shows I opted OUT. They refused to do anything about it and I was told to go into the branch.

I requested that they close my account so that I don't incur other fees, and she said they will not be able to do that until I have a $0 balance. I asked her if any more fees would be charged and she said YES. Clearly I cannot pull $600 out of a tree so it will take me time to cover this. All the while, them adding more and more on top of it!! I don't want bad credit from this account but they are not helping in ANY way since obviously it was a error on THEIR part not being HONEST about their fraudulent overdraft practices.

DO NOT bank with BBVA Compass. They will rip you off at every chance they get. I will *never* do any business with them again and will make sure nobody I know does either.

The problem is that debit cards do not have a regester and are used for way to many things to keep track of.  What most people do is keep track of there balence on their reciepts.  Problem is the reciepts are not reporting their actural balance but the "money in their account"  this is deceptive since allot of the time there are listed charges against that balance that simply have not gone trough.  Yes debits should not go through if one does not opt in but banks are finding ways around this.  My wife who's english is her 4th language was put in a bussiness account for her one person cleanning employment.  She was watching her balence, but the banker never explained to her how that balance may not be the actural amount of money in her account.  The other cutecy thing here being that business accounts debits are automaticly opted in for overdraft charges.  She got tripped up on this and the bank is trying to take $300 in fees from her, one fourth of her $1,200 mo income.  She even has a reciept showing $600 in her account even though the bank was paying overdrafted depts at this time.  Infact, she really did have money in her accout, but they took the money out first before they applied her credit for a refund.  The whole loophole here being it's a business account.  No, this is just theft and taking advantage of someone.

Opting out of the Standard Overdraft Protection does not mean that you can not overdraft.

That only covers Point of Sale Transactions(Debit Card/ATM purchases).  It does NOT cover ACH(Automatic Payments) transactions or checks.  If a bank receives an ACH Transaction or Check that could overdraft your account the bank has the option to either pay the check and charge you a Returned Check Fee or to pay the check and charge you an overdraft fee.  No bank that I am aware of allows you to opt out of an ACH or Check overdraft.  The only thing you can do is to link another account(Savings, Credit Card) to the checking so that if you do overdraft they will pull the money from the alternate source.

This is why it is YOUR responsibiliy to manage your account.  It is YOUR responsibiity to maintain a Written Register that can keep track of your balance.    You should have accounted for the upcoming automatic payment and either put enough money in your account to covver it, or to contact the other company to cancel the payment.   

One side note is that you complain about $150 in fees from the bank.  Well have you thought about what would have happened if they returned the check to the company?  First of all you would have still owed the payment..you can't get around that.  The bank would have charged you a Returned Check Fee(which would have been around $25-$50).  Also, the company would have charged you a fee as well.  But then it gets worse.  If this was any sort of loan or credit card you most likely would have also been charged a late fee(another $30-$50).  You also would have been responsible for additional interest.  This retuned payment could also have put you into default, which if it was something like a car could mean that the finance company could reposess it.  If it was a credit card they could close your account and/or charge you a higher interest rate.  If they reposessed your car at a minimum it would have cost you at least $400 and you would not be able to get your car back until you paid that and the payment that was owed.   If this happened to be something like a utility payment, one returned check could have not only had your utilities disconnected, but in order to continue service they may require you to put down a bigger deposit.

 

Oh and one final thing..don't think that you would be treated any differently by any other bank.

 You set up a payment to go through your account when there was no money available so you blame the bank. You are responsible for your own monies not the bank.  NO I do not work for this bank.

Start keeping a check register, stop relying on online banking and reconcile your monthly statements.  You can change banks but the same thing will happen if you do not start taking care of your financial records.
