First of all let me start by saying NEVER buy a car from carmax. I purchased a 1999 dodge durango from them on 10/5/2003. within the first month the truck was in the shop weekly. Thank goodness i purchased the extended warranty. there were many thing wrong with this vehicle. too many to list however to make a long stary short i have a file folder 3 inches thick with repairs to this vehicle.
buyer beware that when you take your car in for service make sure you check your mileage before and after and also check for body damage. out of the 20 or so times my vehicle went in to carmax for a repair within the first 6 months of owning it they not only went out joy riding with it yes i dropped it off and when i picked it up a week and a half later it had over 1000 miles put on it and 500 dollars worth of body damage. many times i tried to get them to realize this vehicle was a lemon and to just let me trade it in for another but they wouldnt do it .
i found an attorney to file a lemon law suit and can you believe my case was dismissed..... i wonder why.....it is a clear lemon law case. well of course when the warranty ran out which they helped run it out with all the miles they put on it when it was in for service several things went wrong with it things they supposedly fixed when it was in there they refused to take it back in so that came out of pocket. i have had this vehicle for less than 2 years now and i have replaced the trqansmission on this vehicle totally. of course afdter warranty and now it is gone again. if anyone is going to get a class action suit or any suit for that matter against carmax i am in.

My best friend purchased a Volvo from Carmax in Atlanta and had the same problems as you. To this day she owns a car she can't even drive and she too has a file folder about 3 inches thick with repairs that had to be made of which the original problems never were resolved. Come to find out, the car had the same problems with the original owner and she was never notified about any of it before she purchased it. I would think twice before dealing with Carmax as they were never nice about any of the problems and couldn't care less because they had gotten their money. Lawyers were contacted and like you - the case was dismissed. Carmax must have some major connections with the court systems in Atlanta.

Contrary to some of the rebuttals I see, I really think that Carmax quality is solely dependent on the Carmax store location.
I bought 2 cars from Carmax in Greensboro, NC and was very happy with both. They were immaculate and I owned one for 6 years, another for 3.
Then came the Carmax car from hell..which I bought in S.Florida. I should have been concerned when I found that the inspection statement was never signed.
2 days after buying the car, it was back in the shop. I should have followed thru on the 5 day return policy. But I trusted Carmax based on previous experience, so I kept the car.
Long story short, 1 year later, the car continues to break down. Thank God for the extended warranty.
I honestly believe that some Carmax stores do NOT inspect the cars as promised. I've even heard that from former employees here in Florida. It's a shame...it's a tough market out there for used cars... Carmax can't afford to loose business by repeat buyers like me, just because they don't want to take the time to inspect their cars.

Carmax offers a 30day warranty and a 5 day return policy. We do not joy ride in vehicles. I have worked for carmax for three years. We help the customer in anyway possible. I have seen one employee take a carmax vehicle out when unothorized to do so and was fired on the spot. Dodge is a very poor brand of vehicle. I own a carmax vehicle myself and have had to do only minor repairs. It is a USED car. Things go wrong with them especially a 9 year old dodge durango. We sell those cheap. They are cheap vehicles. end of story.

Did you have the car inspected by a mechanic before you paid for it? Did you sign the as-is forms that dealers make you sign on used vehicles so that they are not held liable? Did the dealer offer you any kind of warranty on the car? Did the dealer have any previous history on the truck? It sounds to me like the dealer went by the book. Did you pay Kelly Blue Book retail for the car? Probably not. This is what most buyers face when they do not do themselves justice, do yourself a favor and take the car to a mechanic before buying it! Who would not have it inspected? Its a used car, pay the $75-$100 to have it checked out. I got burnt and now just sharing my $.02

Tina: firstly Georgia's Lemon Law applies to NEW cars only. You said you found a lawyer willing to file a Lemon Law suit for you, well that lawyer is either a dimwit or doesn't know Georgia law very well. Also Durango's especially 99's are notorious for transmisison problems, research a product befor you buy it. 1000 miles in 10 days, sorry I'll be polite here but I can not believe that. I've bought 3 vehicles from Car Max zero problems great cars excellent service. However I researched the vehicles prior to purchase. Sorry Tina your story smells and I am not buying it.

Dismissed case

The judge had dismissed this case due to the fact that everytime it went in to the shop and all the repairs done were for the same reason a different part was replaced each time. they had never replaced the same part on the vehicle when i brought it in for service. We appealed the case and to no avail it was dissmissed again.I still have the repair records ,with another 5-6 repairs to add to them. hopefully one day something will be done about this lemon. I cant give up.

first of all I had a competant attorney who handled my case there are several attorneys in georgia that will deal with the lemon law on used vehicles. here is the web site that i found dealing with this and it states:
What if I Bought my Vehicle Used?
First, if you still had any warranty left from the manufacturer when you purchased your vehicle (or your vehicle was "Certified" by the manufacturer or dealer), and you made at least one unsuccessful warranty claim before the warranty ended, you may be entitled to compensation for breach of warranty.
If not, your case may raise a whole host of issues which are beyond the scope of this "Frequently Asked Questions" section.
However, you may be entitled to compensation for violations of various laws which you may not even be aware of. The following is a list of some of the problems and/or issues which may be present in your vehicle. Your case was most likely dismissed because Georgia's "Lemon Law" applies only to NEW vehicles, not USED vehicles like yours. No competent attorney would file a Lemon Law suit on a used vehicle.
