I purchased a computer form the Brookfield,WI. Circuit City and the sales person opened the box while it was still behind the checkout counter. The sales person the retaped the box and gave it to me. I took it home and didn't get it out of my vehicle and my daughter said that it was the wrong model.

I went back to Circuit City and told them that it was the wrong model number and I wanted the right model. They told me that they didn't carry that model,and I told them I would just return it and go to another place and buy it. The price was only a few dollars more for the right one and was only a few miles away.

They told me that they had to deduct 15% because the box was opened and I told them I didn't open it,that the salesperson opened it and resealed it. Rather then argue with them I took the computer and told them that I would never enter any Circuit City again. Is this the policy that prevents returns or did the salesperson not want to lose a sale?

After they had my money, they opened the box to get papers to activate the warranty. They said it was to check the serial number and to make sure it was correct according to the label on the box.
As far as the model number being wrong,it was more that it was a choice between 3 similar models that were on the wish list. The point being is that I didn't open the box and if I would want to return it I should have that option because I didn't open it.

I apologize for any confusion regarding the restocking fee. Circuit City does charge a 15% restocking fee on select merchandise that has been opened prior to the item being returned. If the store opened the item to perform any Firedog services that you requested and paid for then you would be sudject to the fee since you would have authorize them opening the computer to perform the service.

Computer box opened behind checkout counter? Wrong computer model?

This story is missing some important details:

1. You purchased a computer from Circuit City and the sales person opened the box while it was behind the checkout counter?

I would like to know what computer system did you buy? Did you buy an HP, a Dell or what? I don't remember what desktop models Circuit City sells. Did the salesperson open the computer box, which I assume contains the CPU and monitor together, before or after you handed him your cash or credit card? Did the salesperson tell you why he opened the computer box? I would not have accepted the box after he opened and retaped the box.

2. You daughter told you the computer was the wrong model. Was the computer purchase for her use only or for family use? Why did you not take your daughter to buy the computer if she was the "computer expert"?

3. You kept the computer that you did not research and you did not really want? If you had paid $900 for the computer, a 15% restocking charge would have been $135.

Bottom line: Why did the salesperson open your merchandise and why did you accept the box?
