My wife and I had an account (133034020) with Citizens Bank. On or about October 6, they put a debit hold on the account for suspicious activity. While they never disclosed what they believed to be suspicious activity, I believe it to be the purchase of BitCoin through an offshore exchange. This was part of a research project.

 On October 14, 2014, at the bank’s request we withdrew all funds so that the bank could close the account as per their request. We were told by Gabriel Rodriguez of the Danvers In-Store Branch that the account was closed.

On October 16, 2014, as part of bank automation the account was reopened to post transactions that had been represented due to their debut hold. The bank accepted the items and paid them brining the account negative. Due to relocation issues, we did not receive any notice and we expected that the account was closed. We incurred approximately $240 in over draft fees as a result.

 On or about and after October 22, 2014 several automated payments were presented by various parties. Having been told that the account was closed, we have no reason to expect that the account had been reopened and that they processed these items as over drafts and charge $35 per transaction. Several of which were presented twice as they were returned NSF instead of account closed.

 On or about November 15, 2014, the bank processed an ACH credit which was a refund for services that we had purchased in September 2014. We were not advised of the credit.

 On or about December 6, we received a collections notice from Citizens Bank for approximately $304. When we immediately called, we were told that we had no option but to pay the balance or we would be reported to Checksystems and owing it. At that time, we had lost our home and were collecting welfare due to a financial calamity. I told them I would contact them again when we were back on our feet.

 

On February 24, 2015, I entered the Newton Centre Branch and spoke with Christopher Buras. While he empathized with our situation, he advised that all he could do was to submit a customer service request and we would have to see what happened. When I asked what that meant, he said that there was nothing else they would do. The complaint number is CFGD3946697.

 He provided no time frame for response and only said, “You will get a letter in the mail”.

I am seeking only the balance of $303 to be removed and for the Checksystems entry to be reversed.

More broken promises from Citizens Bank

Sp as of my last post, I had been promised a call to discuss my complaint. It took two weeks, though I was promised 48 hours, only to get disconnected in the first 10 seconds of the call. I was in the car so I blamed my phone.

However, when I called back I was told that it would be another 48 hours for the person to call again. They never called.

After about seven business days, I called again and told them that my unfornate next step was to file a complaint with their regulator. I was promised a call in twenty-four hours. This was 3 business days ago.

At this point, I am going to file a formal complaint with the Commonwealth of Massachusetts Division of Banking and Department of Consumer Affairs. Additionally, I will be filing a complaint with their principal federal regulator.

As I said before, I gave them the money because they had me hostage in a banking transaction and the amount is now the issue. This is an issue of unfair and deceptive trade practices.

I will upload the complaints in the near future.

OD Notices...

Since you claim you were not expecting any OD notices then seeing one in the mail should have been a red flag. The bank would send one for each day that there was an OD/NSF. It's possible that one or two would not get delivered to your new address but to claim that none got delivered is a bit much.

As for your comment about my answer being scripted, I used to work as a Customer Service Rep for another bank. All banks basically run the exact same way. The biggst difference being whether the bank posts debits first and then credits or credits first and then debits. I did notice that you didn't respond to anything else I wrote, so much for open dialog.

Observation..

There are a few things missing in your report that is more of an observation.

You start off by saying that you were requested by the bank to close your account.  You THINK it was because of some bitcoin "research" you were doing.  While not sure why you would be doing "research" on a pseudo-currency that is very prone to scams.  But let us say you did this with all honest intentions.

What becomes more interesting is I can not recall ever hearing about a bank asking you to "close" an account because they suspect fraud.  If a bank suspects fraud...THEY close the account and then make you wait weeks before they send your money back.  If they feel that there is fradulent activity they will close one account, but have you open another.  You failed to mention anything like this happened.  So had you opened another you should have still been in communication with the bank and seen any "overdraft" notices from the other account. 

The next odd part of this is that on October 14th the bank "requested" that you close your account, and by December 6th(not even 2 months later) you have already lost your house, but were now getting mail and are on welfare.  With this "research" you were doing, a fraud claim, and several ACH transactions you failed to cancel.  There seems that there might be quite a bit more to this story and the timing of all of this.

But if we take everything you said at "face value".  You say "as there always are" reasons you didn't get your mail.  So what exactly are these reasons that apparently ALWAYS happen as to why you didn't get your mail.  I ask that because I have forwarded my mail over the years and have not had any issues.  With the exception of the forwarding order expiring after a year, but this is not your case.

Oh and NO I do not work for this or any bank.

Thank you for sharing your opinion. I do have a hard time believing that you are in no way associated with the bank. Your response was a little scripted. Regardless, I will take your statement at face value.

As there always are, there are reasons for us not receiving the mail that are a matter of record with the US Postal Service. However, why would we be looking for these notices if the account was closed?

Nonetheless, it is open dialog that makes this platform work so well.

Even though the account was closed on Oct 14th, any transactions approved/conducted brfore that date must be honored by the bank. The rep should have gone through the transactions tosee what hadn't cleared yet and had you leave money in the account to cover them. You should have asked about outstanding transactions.

The automatic payments scheduled for the 22nd should have been cancelled by you as you know the account was closed. Or were you intending to not pay these debts by having them present against a closed account. If they had been returned unpaid, you would still owe the original amount and returned check charge.

If you didn't receive the OD notices from the bank it means you didn't do a change of address to forward your mail, or you didn't look through your mail.

It didn't help the situation when you took over two months (Dec 6 to Feb 24) to contact the bank afteryou were notified.

 

And to answer the usual response, NO I don't work for this bank.
