ok, so, i had a cell phone from ATT that was in my mothers name. i had had the phone since i was young (parents got it for me and i paid the bill since i was a teenager and had no credit back then) I tired of ATT about a year ago and switched to Nextel, which I love BTW. I got the final bill, or what I thought was the final bill, from ATT about a month later. I paid this bill. 10 months later my mother gets a bill from CCA in the mail for $432 and some change stating that I never paid my early termination fee. After some digging, i realized that the final bill i had received had NOT added in the early termination fee. So, confused as to why a bill never came, but this went straight to the CCA. I apologized to my mother since it was her credit on the line and I called the 800 # on the statement to pay my fee. The woman my mother talked to ( i couldnt talk with them since the bill was in her name) told me that i could make one payment or if i needed to, i could split the payment into 2 payments of $190???? Apparently i could settle the bill of $432 for $380......actually, she tells me, you can settle the bill for $280, but we charge a $50 processing fee for each check. i said, no thank you, I will mail the bill in to you. The woman on the line proceeded to tell me that if the bill was not paid in full by the end of the week that it would be going to leave a negative mark on my mothers credit report.

Reluctantly, but not wanting to taint my mothers PERFECT ( thats right, she has never had a collection bill in her life, which is why i cannot understand why ATT did not just send her a final bill) i decided to pay with 2 checks over the phone. since i only got paid bi-weekly. Which added $100 in check fees, and is absolutely LUDICROUS.............Sound like enough. Both of my checks cleared the bank on the days i had stated to CCA to withdraw the funds. All is good, everyone is happy. UNTIL, my mother gets a bill about a momth ago stating that they never recevied nor did they cash my second installment. I think to myself, no way is that possible. My mother calls and speaks with a "MANAGER" who tells her a fax # and asks her to get the copy of the cleared check with the dates CCA cased it and when it cleared and fax it to her. We did one better, my credit union not only gave me everything asked for, but wrote a certified bank letter to that effect. HERE IS WHERE THE BS BEGINS. We wait a month hoping to hear from someone that this issue has been resolved.

We get another bill, we call CCA again. No one has any record of any conversation or receipt of any fax. We fax everything again. Another month has gone by and now it is october. Another bill comes. We call CCA again, and to our surprise "Yes, Mrs. Evans, we have received your faxes. They have been declined as evidence on behalf of your payment and you still owe us $162.58. What happened to the $190 i ask?? What about the $50 fee?? We charge no such fee was what we were told. As of today, there is no one who will return any of the alomst 10 calls we have made. There IS a very obvious negative mark on my mothers credit. And, as far as I can figure out, unless I RE-PAY this $162.58, they will keep tellng me they never received or cashed the check...............

Can someone give me info on how CCA can refute a bank certified copy of a cleared check? (i sent them copies of both checks just to prove to them that i DID make 2 payments of $190) I have my bank statements, the cleared check copies and a certified letter from the manager of my credit union stating that CCA in fact DID RECEIVE and DID CASH both checks. I am at my wits end with these people. We have called and received the names and extensions of 6 different MANAGERS, non of whom have returned EVEN ONE call from us. How can a company cash a check from you, not distribute the funds as they should have, tell you they actually never received ro cashed this check in the first place, ask for a bank copy, receive the bank copy and then say it was no good????? How can a company steal my money and call a FEDERAL CREDIT UNION MANAGER A LIAR????? Beyond me. If anyone has any info on this please let me know..

THANKS

YOUR FIRST MISTAKE - WAS EVEN TALKING TO THEM -never acknowledge a debt with a CA.

AUTHOR: Laurie - (U.S.A.)

You should have contacted AT&T first. Verified they did indeed send this to collections and find out what the final bill was.

Collection agencies use a lot of nasty tactics to take your money when they have no reason to have it in the first place

If they have not cashed the check - contact your bank and put a stop payment on it immediately

If they have cashed it - then they are only trying to get more money from you by stealing it.

Either way - GO TO www.budhibbs.com and fight these bottomfeeders.
