I purchased a 2006 Hyundai Accent from a dealership and due to my poor credit CPS was the finance company. I made my payments on time every month and then got laid off my job, due to our wonderful economy. I sent them a letter informing them to come and get the car as I could no longer pay for it.

On top of that, the balance still owing on this car is over $11,000 and you can get a new Accent for $9000. They called several times a day, which by the way was a computerized call. I talked with an individual and she said that whatever they didn't get paid I would have to pay or my wages would be garnished. I told her that I sent them a letter informing them that I was laid off. She asked about unemployment. I told her to try and live off of what I get on unemployment. They called some of the people that I used as references and actually told them that I defaulted on the loan. I don't believe that they should have said anything to that affect and consider that an invasion of my privacy. They have not yet come and got the car. In my letter I also informed them that it was no longer insured and that I would not be responsible for anything regarding the car as of the date of the letter. If at all possible, NO ONE should go thru them.

I most certainly do not work for this company or know anyone who does... Unlike you, I just know what I am talking about.

Why is it when someone is IN THE WRONG and someone points this out to them they always cry and say WELL YOU MUST WORK FOR THEM... All that does is make you sound stupid and lets us know you don't have a real leg to stand on in your arguement. Act like you have some itelligence, if indeed you do....

We are all in hard time, YOU are NOT anyone special.. that's what happens when YOU live beyond YOUR means... this company paid out money so YOU could have a car and YOU defaulted so the only one getting ripped off is the finance company, BY YOU.

Before you post any more LIES, I suggest YOU get YOUR facts straight.

First I am not a current or past employee of this company.

I'm not sticking up directly for them, but realize no other company is going to treat them any other way in the same situation. In the end getting the loan was THEIR choice. They got "stuck" with CPS because they have had credit problems in the past, higher risk = higher interest. If you ask any dealer, CPS is usually the lender of last resort, because they finance people who can't get financed elsewhere. So where is the RipOff report on every other bank that turned down the loan?

"...put their personal information out there with strangers, bosses and relatives and threaten them through work, family and intimidation."
- Strangers? I have never seen CPS out on the local street corner with flyers, and I have yet to see a CPS billboard with any names on it. If by threats you mean that they will take the car, and sue you for the difference. Again when they got the car they agreed that the car was security. So if they become delinquent the car can be reposessed, but that does not stop them from owing the difference on the loan. So this "threat" is real, and every other bank would treat it the same way.

"This company has violated just about every law with the Fair Debit Collection Patices Act of 2006 and needs to be brought to justice."
- No they haven't violated any, because they can't. You need to read up on the FDCPA because it ONLY applies to 3rd party collection agencies. CPS is an Original Creditor. So you can sue them for FDCPA violations every day of the year and each and every case would be thrown out.

"You both are working for CPS and it is very evident in your rude and threatening commints."
- I re-read those comments to see what was rude and threatening. They told the truth, and sometimes the truth hurts. This person said they sent them a letter stating they no longer had insurance. That means nothing, as long as they have the car they are responsible. A letter does not relieve them of this responsibility. In fact I will go one step farther. If this person drives this car without insurance in most states that is against the law. So not only is it not a wise idea because of the possibility of an accident, where they would be responsible for all damages. This could end up with fines and/or their drivers licence being suspended.

- No one here is harrasing them. They are giving them the facts of the situation. It is up to them to either ignore it or take a look at it from a different perspective.

Haven't you been reading anything? These people are NOT saying that they don't owe money, they are saying that they have fell onto hard times and wanted to make arrangements with this craphole company in order to get their vehicle paid off. CPS didn't listen to what they had to say or care or work with them and instead decided to be rude, call them names, put their personal information out there with strangers, bosses and relatives and threaten them through work, family and intimidation. Most of these people, if you even read anything, were only a month behind and were just trying to get help. My husband and I didn't know how bad this company was when we got our truck and everyone else who got this company didn't either. YOU JERKS!!!!

You both are working for CPS and it is very evident in your rude and threatening commints. I've noticed that you both have rebuttals on these posts, how much is CPS paying you for this? You are always sticking up for them and I don't see a post from either of you about CPS so there is no reason for you to be here but to harass these people.

I guess they figured if they can't harass people into paying by numerous phone call and threats they would just send you two to come and threaten them in a place where people may get help in order to shut them down for good.

then you'll be paying for a car you dont even have

i know because my cousins wages are being garnished now
she doesnt even have the freakin car. do your best to pay
if anything i know they can help you as long as you make arrangements to pay

you arent the only one unemployed

just because you sent them a letter does not mean that you are not responsible for the car and what happens to it if uninsured... you signed a contract agreeing to pay them back for the money that they paid in order for you to have a car... you will be respoinsble for any amounts that they cannot recoup by auctioning off the car and they are not doing anything wrong. YOU are the one who is. They paid out money on YOUR behalf and now YOU are not paying them back. The fact that you owe more on the car than it is worth is also YOUR fault for having bad credit. You got a bad interest rate based on YOUR credit and everyone knows that for the first few years of an auto loan, most of your payment goes to the interest that YOU agreed to pay. you have not been ripped off, if anything YOU are ripping off the finance company, even if that is not your intention.

I suggest you do everything you can to pay off this loan because once they repo this car, along with your already bad credit, you will find it impossible to get credit for anything again. You are not going to get out of this. Go get a job at a fast food restaurant if you have to but pay off this loan.
