My 16 year old son had his insurance with Progressive.  We changed it to my insurance carrier, but did not know to cancel the other insurance.  Typically, if it is not paid, it is automatically cancelled.  They sent a notice that it was overdue, and I explained to Progressive that we had insured him elsewhere.  They agreed to cancel the insurance effective the date that we had changed insurance. 

The next thing I know I am getting harrassing phone calls looking for my 16 year old son, when I explained that he is 16, and I was his mother, they then informed me that I would be responsible for his debt, even though I was not the one that had purchased the insurance.  I am so angry right now, at Progressive for entering a contract with a 16 year old that I was not aware about, and now this collection agency that is saying I am responsible.  How can I handle this without paying for a service that we did not obtain, and having it go on my credit report?

This is a scam and you need to educate yourself on your rights.

You are correct in the fact that when you fail to pay on an insurance policy, it is cancelled.

However, the only rule to that will be with the state who may not know it was replaced, and may show in the system you are driving uninsured.

Here's how you handle the bottomfeeders that are currently stalking and harassing you.

Stay off the phone.

Only communicate with them in writing, and only by certified mail, return reciept requested. Be sure to put the certified# somewhere in the body of that letter and keep a copy for your records. This is very important to do exactly as described, in the event you end up in court.

Challenge them to prove the validity of said debt. Demand a copy of whatever contract you signed that entitles them to payment.

For example, did you sign an agreement with that insurance company to carry insurance with them for a certain number of months? If not, they have no claim.

And, they cannot even report this collection to your credit report (legally) as they have no legitimate purpose to do so.

File complaints with the FTC at ftc.gov for the FDCPA and FCRA violations. Keep in mind that the FTC will not intervene on your behalf, but your reports are archived for possible future use such as class action lawsuits and/or criminal prosecution, etc.

If they have caused you any real damages, it is easy to sue them and get paid!

Don't get mad, GET PAID!!
