American Gradius (Cross Country Bank) Deceptive, Called on cell phone and left unusual message, Looked on internet and then found what they do to people once you contact them. So now I don't even want to answer when their Phone Number shows up. Boca Raton Florida

I received a message on the cell phone to call them at their number (1-800-759-2241). They left the message in a strange way and when I tried to call them back it was like they didn't want you to get through to them but to just acknowledge that you had called back so they could contact you later. It was just unusual. Once their answering machine picked up it answered american Gradius Inc.

So I went home and looked them up on the internet and found out what they do to people and what they are accused of. I have never heard of them or do I have any of their credit cards etc. So now I don't even want to answer the cell phone when their Phone Number shows up because of what they may try to do. Claim that I have some card of theirs and owe some incredible amout of money.

Report to the FCC

While your at it contact the FCC. This is a violation of the TCPA (Telephone Consumer Proctection Act). They are not alowed to call you with a recorded message on your phone unless you have an ongoing relationship with the company. They can be fined. If after you send them a letter and they have received it you can sue them. Keep records of all the attempts to call you. You can be awareded damages of up to $500 per occurance.

What really suprises me is that there is a phone number coming up on your phone, because usually there numbers are blocked or unknown.

Write them a letter, explaining they better not call you any more because harassement and stalking are illegal. I don't know if the State of Montana has "Anti-Stalking" laws, but they do for harassement. Clarify you have never done business with them, and never will. They are not to call you for any reason.

Then at the bottom of the letter post CC:*

Better Business Bureau
Any lawyer friend you might know. :)
Montana State Police
Helena, Montana Local Police
A Helena detective friend you might know. :)


*CC=Correspondance Copy--clarify this at the bottom of your letter. It may cost you money, to get that signature, but it might be a worthwhile investment for your safety. Their Post Master has to give them a note in their Post Office Box, so they go to the counter and have to provide a SIGNATURE, in order to get your information. And you should really send a copy to your State Attorney General Mr. Mike McGrath, 406-444-2026, or write: to him at: Justice Building, 215 N. Sanders, Helena, MT, 59620-1401, your site: http://www.doj.state.mt.us/
