Don McGill Toyota-Katy Ripoffed by financing manager trying to keep our down payment Katy Texas

My daughter and I went to Don Mcgill toyota in Katy to look for a good used car. My daughter found a nice car so we negotiated a price and went back to finance. Vada Caccamo, the finance manager showed us the numbers, she added a gap insurance policy for 191.67 and an extended warranty, which we were told by the sales guys this was included but it added an extra 2500.00 to the price. Also a 19% interest rate. My daughter put down $1900.00 and she has no credit. I told her we didn't want those extras and we wanted a lower interest rate. She explained to use that the interest rate wounld be lower once it was approved and that the extra insurance and extended warranty would need to stay on there in order for the application to get approved then we could get it taken off.

In a rush to get to a wedding my daughter signed all the papers and drove off with the car. Monday rolls around and I call Vada to get the extras taken off the contract because after reading everything it states they are NOT needed to get financing. We arrive in her office and she tells us the loan was not approved so she couldn't change the contract until she spoke to someone at Toyota finance to get the loan approved. I told her to nevermind we just want to return the car, she said "no" that's not the way it works and if we were to leave the car there it would be repossessed and put a black mark on my daughter's credit. Wednesday rolls around and the salesman calls us to tell us the loan was not approved and we would have to return the car. We showed up and returned the car expecting to get back her $1900.00, the sales guy said the manager was not giving her money back, after a long agruement and a call to the sherriff's department, the manager refunded $1300.00 of her money and told her he was charging her $100 a day rental fee and .25 cents a miles for the time she had the car, a total of $575 or so and he would mail her a check for the remaining $25. We are both livid about this and will not only report it here but will report it to the BBB, the news and also will file in small claims court.
