Yestreday, Sept 18, 2018 I parked on 80 sw 8st the parking lot in front of Brickell City Center. I was goign to buy sushi or pizza and also pick up a package accross the street. I crossed the street and a friend gave me the package, when returned to the plaza to buy dinner, I found out that Mr. Seth Vela from Elite Booting had put 2 inmovilizers in my car. He explained that I could not leave the premises and that is why I was being inmovilized, which is abusive! it only took me a the time the light changes to red to croos pick my package and return. I called the number to get the inmobilizers removed and a very aggresive lady forced me to pay. of course I had top pay because I needed to go pick up my daughter on time! of course with no dinner as this guys abused and could not buy dinner! While I was there, about 3 more victims! This is completly abusive! We cannot allow extorsion. I will go to the media and to the authorioties to fight this ilegality.

Dear Robert, to answer your questions, 

 

Was there a sign? Yes, there was a sign where it says for customers. I was going to order in the sushi or the pizza place, but my mistake was to cross to the other side of the street to get on my hands an envelope from a friend. I did not wnet shopping around nor left my car more that the 2-3 minutes that takes to cross street, say hi, pick envelope, say bye and return to buy dinner. 

My native language is not english, I am a foreigner who moved to Miami some months ago. Not to claim unfair or misleading, but if the parking place has cameras and they consider that leaving the premises is not allowed, the person there could have told me or explained versus allowing me to walk accross and then when came back had already put 2 inmovilizers and charging 49 dollars for the 3 minutes. That is why I am pissed, while you might have a point saying that I was not alloed to leave the premises, which by the way I find completely outrageous, the person could have pointed that to me versus what it really looks like, that they want to make money by abusing. 

Grace period? none! telling me verbally the consequences: none! they just have a camera an a person reacting as to the instructions of the person watching the camera.

Yes, they might have a parking problem, but its not solve by inmovilizing cars and charging 49 dollars fro removing them. They can find other alternatives as other parkings. They can charge a fee for parking and people like me will have no problem of paying a fee. 

What its not right is the way they operate, both their mechanism, attitude and manners are not correct. Both the guy and the lady on the phone were agressive and insulting. This is why I am reporting, because that is not right.

You can read what happen some months ago, yesterday a colleague shared what happened in that parking lot some months ago. The employee of Elite Booting hit a customer that denied to pay. This is totally wrong. Violence does not solve the problem.

And yes, I might be used to other rules and have not read the sign, but no excuse for the way they reacted and treated me. I was a customer of the business ther at the plaza infront of Brickell City Center. 

Just to finalize my note, I have no issue with paying for parking. I could have used the valet infront or the pay by phone app to park in the street. I had NO idea that I could not step out some meters away from the plaza where I was buying dinner. If I had known, I would have never p[arked there to buy dinner and pick my envelope. 

You might have your point of view, but what is totally wrong is using a loop in the laws and using violence and power to take money from people that might have not read the exact rule and abuse the lack of knowledge. This parking might have an specific rule, but generally as long as you buy and consume you can use the parking. This has been a learnign experience and I will watch out for signs. As a lawyer I do respect the laws, but I will campaign to make people aware of the situation and different ruling of this specific place where things are not mangaed correctly.

Was there a sign in the parking lot that stated it was for Customers Only and could be subject to booting/towing?   I would bet that there were, but if not then you MAY have a valid complaint

When you left the parking lot were you still a customer?  The answer is NO, but you weren't even a customer yet as you hadn't even bought anything. So you could just be saying that now as a way to justify just parking there for a few minutes. By the way perhaps Google Maps is out of date but there isn't a Pizza or Sushi resturant anywhere near the address you stated you parked at.

Did the sign give any sort of "grace period" before you were subject to booting/towing?  If not then why would you think you could leave the parking lot

Oh and if they were able to boot 3 other cars in the time you walked across the street, that just proves that they apparently have a bad parking problem.

As long as they followed the law, you may not like it but there was nothing unlawful about it.  If you want to be able to park where ever you want then you need to get the laws changed.
