The garage area where the car was parked for pick up is extremely dimly lit and dark inside the garage and both me and my sister searched for any damage.  I walked around the car several times and so did my sister.  Then, I told the EZ Rent A Car Customer Service Agent/Parking Lot Attendant the person who gives you your car in the garage that I was worried that is was dark and even harder to see things on a black colored car.   He stated, Just look for major damage.  I said, what about that door ding? He said, Door dings are normal, dont worry about those.  My sister and I walked around the car 3 more times and then when I came over to the little building to sign papers I asked my sister to keep looking which she did.  I said to the Agent, could you please take a look also, because I am worried that I may have missed something and its very dark in here.  He walked around the car and said with a smile, everything is fine, youre good to go.  Both me and my sister heard him say that.  

After we drove off we both looked at each other in disgust at the smell of cigar smoke and stains on the back seat.  This car had definitely been in some rough hands.  After about an hour down the road

we stopped at a Chic-fil-e  and and again looked at a ding in the door and we worried if it would be a problem later. 

I always take very good care of everything and anything in my possession and my own cars are testimony to that.  I am a very honest and responsible person with a perfect driving and credit record. 

At no time during the rental cars tenure with me was it damaged in any way.  There may be some dings on the car but no new ones occurred while I had it.  I repeat: the car was not damaged in any way

while in my care!  I have no reason to lie about this. I am a professional with a perfect credit rating, perfect driving record, with a masters college degree and a professional career.  I am 56 years old and never had any problems with anyone of this nature or of any kind whatsoever. 

On Saturday, August  11, 2012 I returned the car to the EZ Rent A car garage and asked the attendant to inspect the car and give me assurances that everything was OK, which he did.  Again,

I asked for his full assurance that everything was OK and he smiled and said yes, everything is fine. He asked for the keys so I gave him the keys and we left.

I returned the car in the exact same condition as I originally received it.  I have 3 eye witnesses that thoroughly inspected the car before and after which proves no damage occurred while the car was in my possession.  I took the utmost care of the car.   I can prove the car was not damaged in my care. Thats because it was not damaged while in my care.  All I did was drive the car to Gatlinburg and park in the Hotel parking lot, the Hilton Garden Inn, until we returned it. 

If EZ felt the ding on the door was prior damage that you needed to claim, then you shouldnt have rented me a car with damage.  Since they inspected the car when I returned it and concluded that everything was OK and no damaged occurred from the time I took it to the time I returned it, how can they possibly claim it was damaged in my care?  If it was damaged sometime after I returned it, and after I left, how can that be my responsibility? How can they, without any cause, and without any justification, and without any support, send me an estimate for damage that I did not cause and did not happen while I had possession of the car? And after three letters demanding I pay up

for something I did not cause and for something I had nothing to do with?

There was no claim of damage made to me while I was present at the garage even though there was ample opportunity to do so.  This is not right just sending me a bill with no evidence and no discussion after the fact. Because if that was their policy, the same garage attendant would have remembered me and would be obvious that I did not cause any damage. 

How can someone just send a person a bill without any reference or evidence that anything is owed? How can someone accuse another of wrongdoing without any due process of law? How can you say I am responsible without any witnesses? After an EZ agent clearly acknowledged that no damage was incurred can the company override the agent and without any basis accuse me of causing the damage?
