Fred Loya is engaging in insurance fraud in California and has violated Cal. Penal Code Section 550 (b)(1). Moreover, by engaging in insurance fraud through the U.S. Mail, they have violated 18 U.S.C. Sec. 1343.

In a claim that I am working, wherein Fred Loya Insurance is the liable party, they have intentionally used a similar, but lesser valued vehicle to determine the total loss value of the damaged vehicle. They used a 4 cylinder vehicle for calculating value knowing that a 6 cylinder vehicle was the actual vehicle damaged.

Insurance fraud is a two-way street. Cal. Penal Code Section 550 (b)(1) makes it a felony to present written or oral evidence IN OPPOSITION to a claim for payment, much like it would be a felony to overstate the value of vehicle.

For example, if one were to state that the car stereo that got stolen out of their vehicle was worth $500 knowing that it was only worth $20, that would be a material misstatement and a felony under Cal. Penal Code Section 550 (b)(1). Now, if one were to do that with over the phone or through the mail, it would be a violation of 18 U.S. Code Sec. 1343.

The same holds true for insurance companies, like Fred Loya Insurance, that knowing misrepresents the value of an vehicle or vehicle part in OPPOSITION to a valid claim for payment. If you have had a similar experience, there are laws that may be able to protect you. Undervaluing vehicles is just as much a crime as overvaluing vehicles. Regards
