We recently had a new baby and she was born with a disease. We didn't know what was coming so figured we better get some reliable transportation with a good warranty. I stopped at Gettel Hyundai to look at a vehicle . I looked at the Entourage minivan which was affordable, had a great warranty, would fit the kids, and be safe for the wife.

It had only basic features and was 19,400. Due to having to take the baby to doctors and not getting to speak to my wife about it they had sold it when I finally got back a few days later. I was told it was the only one they had and they didn't know when they would get more but were sure it would be awhile.

I understood they couldn't hold it for me and was told they could get another Entourage, but it had "pack 2" features and would be approx. 2000 more. I needed this vehicle and didn't have time to look around so I agreed. They said that I had a choice of red or black, so I said red. So I brought my co-signer in and we signed all the contracts and got approved through the bank.

This was on the 10th of the month and I had all the papers, contracts, etc. saying this was my vehicle. The salesman took me to the service dept. to set up my first oil change and introduced me to the service people. So I left the dealership owning a car that I, (according to the contract), was paying for from that day. They told me they would get the vehicle and detail it and all that was left for me to do was pick it up and drive it home. So on the tenth I was paying for a vehicle that I wasn't even getting until the 11th or possibly the 13th.

So I called them on the 11th. to see if my vehicle was ready and was told they would check on it and call me. I drove to the dealership and was told my van, that I already bought and had paperwork saying it was mine, was sold to someone else by the dealer they were getting it from!!

So I figured they would work something out to make ammends for this egg on their face. Instead they treated me like they didn't care. Except for the one salesman who seemed rather embarrased.

When I wouldn't buy something more expensive they tried to put me in a vehicle that wasn't even a Hyundai, it was a Dodge minivan that was 2 or 3 years old. It had approx. 30,000 miles on it, the carpet on the floor was ripped, the visor was broken, the paint had chips taken out of it, the headliner was stained, the carpet on the floor was spotted, and numerous flaws on the interior. It had approx. 2000 miles left on the warranty and they wanted to sell it to me for 15,000.

So I asked since I had already bought a vehicle with a 10 year warranty on it ,and they sold it ,could they at least put an extended warranty on it. I was beat down and just wanted to get a vehicle and get to my baby. They said no, but I could purchase one for 3 or 4 thousand dollars.

So then I was at the point where I was paying the same thing for this junk as I was for the brand new vehicle I had already bought. When I wouldn't take that I was just told there was nothing else they would do for me.

I asked the gentleman who writes the contracts if this was the way Mr. Gettel treated his customers and he said "yes, it happens all the time".
Apparently as a consumer you have no grace period to change your mind but the dealership has 30 days to void a contract. I emailed and asked Mr. Gettel to call me and almost two weeks later I am still waiting.

ok wait....do you have a vehicle or not??? The bank that financed this should have this down as a secured loan so they will have a problem when they go to file their lien on the vehicle and the title shows a lien already...you cant have to liens on 1 title and the another thing is you shouldnt be paying or anything because per the contract you were delivered a vehicle...you should get a lawyer if what you are saying is true.

The dealer was negligent by probably locating the vehicle on the computer at another dealer but then not actually calling to see if it is in stock and if they can have it until you left. A dealer locate as it is called will show the vehicle in another dealer inventory but it may be sold or being held for someone so dealerships will call first to see if it is available.
I have a blog on google that I am trying to answer/solve things like this as they are happening for other people.

If the scenario happened as they stated (doubtful) they should have immediately found you another (even if it was located at a further dealership for them to go get) and if they couldn't find one called you immediately to let you know the situation and see what you wanted to do. Either way a car dealership cannot make you sign a new contract.
