EMERGENCY!!!! Help us! Green Tree (Conseco) is threatening to evict us out of our (mobile) home on Monday, we have not even had time to pack our bags. They said they are going to call the sheriff and he is going to lock us out. Can they do this? Is this legal??? Does anyone know the Indiana state laws, can they just do this with no court order?? We have nowhere to go and will be living in our car if this happens. :(.

We have had a 30 day notice letter, which only said that they could start proceedings against of if we did not pay. My mom was trying to work something out with them on the phone but a green tree supervisor inuruppted to yell at her and tell her that he was through messing around, we had to be gone.

I read a few posts on here and it seems everyone that interacts with this ruthlessly vile company has a horrible experience. They are so cruel to me and my mom and reduce her to tears. We are behind because she just got into a very serious auto accident a few months ago and was out of work for months, she still was not ready to go back to work but HAD TO because of our bills. We fell behind on our payments and even if we were to come up with the money they have said that they will not let us keep our home. We just want some time to find a place & to move out.

I read a posting and someone said something about them having to get some kind of WRIT to kick us out and that it would take 30 days. Is that true in Indiana as well? Or just all over?? Does anyone know??? I am begging for help here my sick mother & I (plus our poor pets) have literally nowhere to go.

If anyone has any information or support, please PLEASE respond ASAP. We might not have much time. Sorry for the grammar here, I am upset.

State law probably requires them to file something with a court, and you probably have the right to appear in court to contest it. But this is strictly a guess. In some states a mobile home may be like a car and the lender can just take it even if the payment is only a day late. You need real legal advice from someone who is qualified. Try the "ACORN" organization or your local Legal Aid.

Read some of the other reports on them. They say that stuff about the sheriff a lot, and they're almost always bluffing. You are only one or two payments behind, right? That's really too early for them to consider a repo to be their best business decision.

The reason is that once it is repo'd, they will likely never receive another payment from the owner. The owner has no incentive if they can't continue living there. Also a repossesed mobile home, or any used mobile home for that matter, has very little cash value. They won't be able to sell it for anywhere near what your mom would be paying over the years.
