April 24th 2011, purchased a camcorder through HSN using flex pay.  On the same day I purchased an ACER computer using the same bank card and same flex pay.   HSN charged my bank account over $200 and then called me several days later to tell me that they had canceled the ACER computer. That they could not do the flex pay on the computer because they had ran a credit check through Experian.

HSN was never authorized them to run a credit report.  They can be severely fined for violating the FCRA, especially if they have committed these violations numerous times which I am sure this is the case after reading other RIP off complaints. 

Secondly, I have a freeze on my credit reports so they should have had no way to obtain a copy of my credit report from any of the three credit bureaus. Therefore, the credit bureaus are in violation and subject to being sued.

What they are doing is totally illegal.  Thanks goodness for the RIP OFF report website so that you can search these types of issues to see how many other consumers have been victimized.

 

If you have been victimized by HSN, I urge you to file a complaint with the BBB and the Federal Trade Commision. Also call the credit bureas. I am working on finding an attorney to file a class action law suit againt HSN & the credit bureaus. I am also researching to see what type of penalities and fines can be imposed against HSN and the credit bureaus by regulatory agencies.

I really want this to cost them in the pocket book as this is totally wrong and illegal.

FLEX PAY CREDIT CHECK HSN NO APPLICATION TO FILL OUT!!

There is no application to fill out for flex pay at all.  You just opt for flex pay if you desire it when you are calling in or entering your order via their site, and it is advertised that anyone can use flex pay if you have a major credit card.  You see no legal jargon at all, it is not like filling out a credit card application.  HSN says nothing about a credit check when you decide to do an order on Flex Pay.

HSN UNAUTHORIZED CREDIT CHECKS

I have never applied for credit with HSN and found out they checked my credit when I was doing a  flex pay on an Ipad last week. they cancelled the order without my knowledge and when I called they said they did a credit check.  They never advertise they do this, they say flex pay is for everyone as long as you have your own credit card or you can apply for an HSN card which I have never done.

There was no application requirement.  I simply called in and provided HSN with my credit card information to set up the flex pays.  I was never informed that a credit report would be ran, never consented verbally or in writing.

Right on the Credit card application you need for FlexPay it says they have the right to check your credit report. The card is World Financial Capital Bank.

The only issue here is why they shipped the Camcorder BEFORE checking your credit report and approving you for a card that was later denied.

There may be penalties due to the companies involved but you must be able to prove you suffered damages to win a law suit. A class action suit requires that a large group of victims suffered damages. You did not describe any damages or rip off.
