I WENT TO MR. TRISTAN PATTON TO HAVE HIM FILE MY TAXES. AFTER TAKING SOME INFORMATION HE SAW THAT I WAS ALREADY IN THE SYSTEM AND WAS LISTED AS HAVING TWO DEPENDANTS. I TOLD HIM THAT THE DEPENDANTS WERE NO LONGER RELEVANT. I TOLD HIM THAT I WAS AUTHORIZED TO USE THE DEPENDANTS BUT DIDNT WANT TO IF THERE WOULD BE A PROBLEM. HE DID SOME CALCULATING AND CAME UP WITH THE SUM OF ABOUT $5700.00. AND AFTER I QUESTIONED HIM ABOUT THE SECURITY OF THIS REFUND HE SAID "THEY DONT LOOK AT THIS SMALL AMOUNT OF MONEY THE IRS WAS AFTER THE BIG MONEYMAKERS." HE TOLD ME ABOUT A GOLD GAURANTEE OFFER AND THAT THERE WAS A FEE. I ACCEPTED THE GOLD GAURANTEE. HE ASSURED ME THAT THIS WOULD PROTECT ME IN THE EVENT OF A PROBLEM. HE FILED THE RETURN AND HANDED ME SOME VERY DISTORTED PAPERWORK AND BECAUSE IT LOOKED SO BAD. HE SAID THAT HE WOULD CALL ME IN AND HAVE ME SIGN OFF THE FOLLOWING DAY. I NEVER RECIEVED A CALL. WEEKS WENT BY AND PART OF THE RETURNED SHOWED UP IN MY ACCOUNT. A FEW WEEKS LATER A LETTER FROM THE IRS. I TOOK IT TO HIM HE SAID DONT WORRY ABOUT IT IF I DIDNT CONTEST IT I JUST WOULD NOT RECIEVE THE OTHER PART OF THE RETURN. I TOOK HIS WORD BEING THAT HE WAS THE TAX PREPARER. LATER ON ANOTHER LETTER FROM THE IRS SAYING THAT I OWED THEM MONEY. I AGAIN WENT TO MR.PATTON. HE NONCHULANTLY TOLD ME ALL HE COULD TELL ME WAS TO CALL AND MAKE PAYMENT ARRANGEMENTS. HE THEN STOOD UP AND SAID HE WAS GOING TO LUNCH AND THATS THE LAST IVE HEARD OF HIM. HE NEVER HAD PROPER INFORMATION TO LIST DEPENDANTS AND WITH THE INFORMATION I GAVE HIM HE DID NOT FOLLOW LEGAL TAX FILING PROCEDURES. I FEEL I WAS MISLEAD AND RIPPED OFF AND THAT HE WAS A MISREPRESENTATION OF A LEGAL TAX PREPARER AND A TAX PREPERATION COMPANY.

Jackson Hewitt (especially in your area and those around you) has been caught filing fraudulant returns. Basically, customers would come in, tell them how much they wanted to get back, and the preparers would tell them what they needed (based on their W2's) to get that amount of money back. If that meant dependents magically appearing or extra earned income suddenly coming into play, then so be it.

I know for a fact there is a lawsuit being prepared in the Montgomery area, although I can't provide you with details. Call a few lawyers in your area and ask for a free consultation and discuss with them your options. Be sure to bring any paperwork associated with the case.

If you no longer have the paperwork, or you need proof that you never signed, then go to the office that prepared the return, request a copy of your previous return (usually provided for free) and do not mention why you need it. If they catch their error and ask you to sign papers now, refuse.

If what you are writing is true, and I have no reason to believe it is not, then you had an awful preparer.

You told the preparer not to use your two dependents, but it looks as if he did, as your refund looks like it may include EIC. He presented you incomplete or questionable paperwork, and then told you he would rewrite the return. But it appears he sent it (without signatures?)

He advised you to ignore an IRS letter. That was simply agregious. NEVER ignore a letter from the IRS.

The IRS only looks for large moneymakers? No way! More lower income earners are audited than any other group, particularly if EIC is involved.

I would never go back to that office again, no matter if the preparer is still there or not. There are so many things wrong here that it appears that this preparer particularly is ill-informed or irresponsible.

My advise is to go to the IRS, explain the situation to them, and let them help in correcting the errors. The IRS, despite their reputation, is really there to help. (I'm from the federal government, and I'm here to help you). While the problem with the JH preparer may be isolated, it is still a problem for you. If you do not want to go to the IRS, go to another tax office (BLOCK, CPA, etc) to have them prepare an amended return. However, as long as the IRS is auditing your return, an amended return will not help, but will confuse the situation.
