I had recently went on craigslist, and saw an ad that said apply now. it listed the phone number to call with no information about the job. But i really needed a job, so I call and they gave me no information on the job, just to come in and fill out an application. they also asked if I would be able to start in two days if hired. I said yes. They gave me the address, and off i went.

It was located in a small office building down town. when i walked in there were about seven or eight people applying. Once again I asked what is this job for, they told me that it was assembling equipment. Once i get to my interview, The guy starting hitting on me. (not mentioning any names.) I was immediately hired, because of my looks, not ability. I was told it had to do with kirby vacuum's. I had not known what a kirby was, i just thought If i could sell something of higher value in the past, I could sell a vacuum.

   we started two days later and training went from 10:30am-3:30pm. not bad. until even during training my boss would continue to harass me. he would flirt and touch me inappropriately. IN FRONT OF MY COWORKERS!!!!! there was even a time he offered to pay me for sexual relations. After our training, we were required to go to the office for our morning meetings, at 10:30am then immediately after we would have to go somewhere 40 miles away, and go door to door trying to sell the kirbys. even if we got in we still didn't get credit for it. (our "team leader" got all the credit) that lasted from noon to about ten thirty at night if not longer.

A month had past and we were at our morning meetings, and i started realizing that I have been here for a month, have spent no time with my family and was spending about $40 a day in gas. only to realize i haven't seen one pay check. No one had seen a pay check. I realized it was a scam when i befriend someone there that had been there for months beyond months and had only made $30 dollars. I quit the next day, found out thats its fraud, they were not planning on paying me ever. these people make you believe your gonna make all this money and your just wasting your time. they owe me around $700 that i am never gonna see. not to mention the $40 in gas i was spending a day which adds up to about $1240.00 almost the same amount as a kirby. I was thinking about suing for sexual harassment and for not receiving pay, along with the money spent on gas. however I could not find a lawyer that would take my case. the labor board cant do anything either. My suggestion, is NEVER WORK FOR THESE SCANDULIS USERS!!!!!!

Kirby Sexual Assault Harassment

Former employee (contractor) Kirby here is my experience: They destroyed my entire life for 20 years all for filing a sexual harassment case with NH Human Rights Commission. They hired a gang stalkers to target my entire family stealing children. Also targeted the son of the investigator in my case. Hired a producer in Hampton to drug and sexually assault me for a week. The gang stalker also used this information placed themselves as FBI and Police informants to deny me justice tell lies and blacklist me from lawyers, jobs, and even marriages. Stole my child and land illegally committed probate fraud. Kirby is highly organized criminal gang and dangerous- this just the tip of the iceberg. They have repetive history of sexual harassment and hiring rapists.

I took a couple days of training and decided not to pursue working for the distributor.

I have some tax and business experience and have discovered that their contract withe the dealers is illegal. Both at the state and federal level there is a legal defintion of an employee and an independent contractor. The contract that dealers sign with the distributor is so restrictive that under the law the dealers are defined as employees.

That means that the distributor must withhold federal and state income tax (if your state has income tax). The distributor must also pay their share of medicare and social security tax and federal state unemployment tax.

You should file a complaint with your state department of labor and department of revenue.

If you are classified as an employee the company owes you the minimum wage for the hours you worked or at least 40 hours a week.

If you have filed a tax return as independent contractor you should go the website www.IRS.gov and download form SS-8, fill it in and send it to the IRS.

Note: I am not a labor lawyer but you have the right to file a complaint with the state agencies and the IRS and have them make a determination of your employment status with the Kirby distributor.

I am sure that you got these statistics (hype) through your indoctrination.  Every door to door company boasts this same line.  I would mention the names but ROR would probably delete them.

The real millionaires are at the top of the corporation.  It's easy to understand that they got there on the backs of non-paid workers (dealers as you call them).  Imagine how much free work they get out of people every day.  The OP lasted a month, some last longer, but all are replaced every hiring cycle.  You would make more if you clerked at a convenience store.   You should always get two things in writing on a job interview, 1)Salary  2)My responsibilities/function within the company.

It is true that some distributors use vague or unclear wording to get folks to try their hand at being a Kirby Dealer. I had no prior door to door sales experience and would not have given it a try otherwise. However, once you get to orientation, it is all explained to you.
 
 How much money you make is determined by how good you are at it. The Van Driver gets credit for the sales of the dealers in the van. The Canvasser gets credit for getting you in the door. You, the Dealer get credit for the sales you make. If you have done your job right you can get the sale closed at full price. If you are not a good salesman the van driver must try to cut the price until they make up for your lack of ability to sell the customer. The first thing they cut is your commission. Not their fault. Not everyone can be a salesman. The Kirby Company gives you the chance to try. They supply you with the equipment and training absolutely free. You are an independent businessperson. If you are willing and able to succeed you can make an excellent paycheck. Otherwise you might not be cut out for this field of work.
The van is for beginners. Once you learn to do the job well you can be more successful on your own. Like any business this requires a certain amount of investment such as gas, time, and effort. If you are good at what you are doing you will put money in the bank. If not, well who's fault is it?

The Kirby Company has been in business for 95 years. It has produced more millionaires than any other business out there. Those who fail have no one to blame but themselves.

As for the sexual harassment, That is a problem that you should take up with the supervisor of the guilty person. No one should have to put up with that. Unfortunately, it is a common problem no matter what line of work you are in.
I'm sorry if I hurt your feelings, but I, and many others like me, are doing very well as Kirby Dealers. I appreciate the opportunity Kirby has given me.
I hope you find a job that more suits your abilities.
