I went to visit a friend of mine who lives in an apartment complex. The complex is RiverHorse Ranch in Pflugerville TX. Located at 1525 Grand Avenue Parkway in Pflugerville Texas. When I parked my full size pickup in the parking spot at the end of the row my left rear tire was resting on the curb. Approximately two and a half hours after I came out of the apartment my truck was gone. I called 911 to report my truck as stolen, only to realize it had been towed by Elite Towing and Recovery. The reason they stated to me was because the left rear tire was resting on the curb.
The very rude lady I spoke with in the trailer at their storage yard at 2905 W. Howard Ln charged me $187.40 to get my truck out of the impound. Turns out the tow was completely illegal by state law. State law does not prohibit a vehicle from having a tire on the curb. Even the policies of the apartment complex only state that parking is restricted on the sidewalks, patios and grass. A curb is never mentioned.
When I attempted to speak with Kym Schmoyer, (The owner of the company) she was very rude and had no interest in speaking to me. Her employees were as equally rude as she was. I gave Kym Schmoyer the oppurtunity to refund the money that I was owed before I took the matter to court. She declined my offer and our court date is pending as of the time of this posting.
Watch out for Elite Towing. If you have been towed by them there is a good chance the towing of your vehicle was illegal as that seems to be their common business practice. Elite Towing had to change the name of their company due to the shady and illegal business practices associated with the previous name and owner.

So it's ok for this company to operate illegally without the proper insurance and DOT safety compliance? The tow truck driver along with the owner should be in jail and should be forced to refund all the tows during this time period. Kymco is noting more than a sleaze ball company preying on innocent victims.

I bet you didn't know that Kymberley Schmoyer actually lives in the apartment complex where you got your truck towed, apt. 15207 if I recall.
She trolls the parking lots in the dark of night searching for "tows", some life huh?
Ms. Schmoyer, born May 23, 1972, is a prolific liar and skirts the law at every chance to bottom feed off unsuspecting victims.
Travis County sets towing fees at a maximum of $130.
But Kymberley pads the bill with impound fees, storage charges, surcharges, equipment fees, mileage fees and etc.
These "bullshit" fees balloon a $130 tow into more than $250. Padding bills that are already outrageous isn't what the law was intended for.

Use Common Sense When Parking

Okay, I have heard from everyone involved in this towing incident, so allow me to make a few observations.
First, the parking facility where Jeff was towed from IS in compliance with the Texas Towing Statute, Occupation Code Subchapter F, 2308-251.
Secondly, Jeff seems to think that him being a police officer with the Cedar Park Police Department, his views of the very State Law that gives the property manager to legal right to have his vehicle towed, does not include him. (The Governor's son was towed for being parked in a handicap space)
Thirdly, what Jeff has failed to convey in his report is the continued verbal abuses, slanderous comments and the use the Cedar Park Police Department computers to send harassing emails to the owner of Elite Towing and Recovery.
As in the conversation I had with Jeff Teasdale when he contacted me via my website, www.texastowingcompliance.com, the parking facility he was towed from is in full compliance with Texas State Law.
Parking your vehicle "on top" of a curb instead of in the parking space, is just asking to be towed as property managers have a responsibility to maintain the appearance the parking lots for their property owners.
