I was given a summons in Sept. 2002 in our front yard for my husband. The server asked: "is Robert home?". I said he was asleep on the couch. The server gave me a summons and left.
Issue 1) The summons was for my "ex" who no longer lives here...
Issue 2) they both have first name of Robert. The server never confirmed which "Robert" he was serving. My ex-husband never got any further legal documentation from anyone, not the court, not through the mails, etc.
In searching the web, I discovered that Love, Beal and Nixon had gotten a default judgement against my ex-husband for a debt which is SOL and was filed in a different county than the one he lives in or where I was served.
Is this a "legal" judgement? We had moved from CA to OK and had financial difficulties and could not pay debts and feed kids also. Kids won out. All debts are SOL, but both ex and I are still being "called" by debt collectors, but no documents or billings are being sent.
We do not answer phones, yet they are still calling. Got another call yesterday from Love, Beal and Nixon did not answer.
Will they ever go away?
What does my ex do about the judgement that was filed in wrong county and he was never given any documentation regarding it at all?

He can get that judgement vacated, but will need a lawyer to do it. If you had 2 Roberts in your life, you should have said Robert who? And then you should have made sure the other Robert got it and responded to it as required.
There is a 35 day response period in OK. The only reason a default was issued is because nobody responded. You cannot just ignore a summons and expect nothing to happen.
It would have been easy enough to beat.
