First I'm contacted by LVNV Funding LLC 3451 Harry Truman Blvd-St Charles MO 63301-4047 (636)947-2321 (800)521-3236 Fax (636-947-1565 for a past due debt in April 09, they make me a settlement offer that will settle my debt in full.  I pay the agreed upon amount.  July 2009 they call me at work to collect the amount they agreed to write off.  I fax Stacy Whitley the the written settlement offer and payment information.  August 13, 2009 I receive a letter from Resurgent Capital Services 15 S Maint St. Ste#600 - Greenville SC 29601 requesting I pay off the amount they agreed credit. I have again faxed all the documents to their office showing the settlement offer, payment made in full and my correspondence with LVNV Funding LLC.  I also filed a complaint with the Attorney Generals Office in SC for referring an invalid debt to what now turns out to be one of their other alias' out of state.  So tell me since I now find they have at least 12 other alias', do they just hand it to the next guy in another state so the Attorney Generals have no power?  How can they keep harassing someone to pay a debt that has been paid full per their specifications? Something tells me I'm going to be writing at least 10 more nasty letters and contacting many more Attorney Generals in regard to these unethical business practices.


Wish I'd never paid the debt.  They only go after you if you try to do the right thing.

I too have been attacked by this company, but I personally refuse to pay anything to them.  In their lawsuit against me, they made numerous fraudulent statements in their petition and I called them on it.  So, I filed my own lawsuit in small claims court, both are presently pending and LVNV is having to pay 2 different attorney firms to fight this in 2 different courts.

I also agree that this company does illegal things at a whim.  If you have done what you agreed to, but yet they continue to hound you, take them to court.  I don't know what your jurisdictional limit is in small claims court, but if it covers the original amount that you agreed to settle for and that the the court recognizes under their jurisdiction it will cost you a little money to file the suit.

I would suggest that you look in the FTC (Federal Trade Commission) Rule book under the Fair Debt Collection Practices Act and see how many of the laws that they have broke and file suit under those.  But never-the-less, file a formal complaint with the FTC because I can promise you they are showing it on your credit reports.

Since they have broke multiple laws in this Act in my case and they know it, that is why they are trying to work out a deal with me to buy my silence.  Slap a suit is your best and only alternative to put an end to this nightmare.
