These people first contacted  me about a year and a half ago stating that I was being sued for unpaid credit cards.

I explained why they were not paid wich was because i had lost my job and could not find a decent job for 2 years. I also explained to them that I had a handicapped sister that I was left to care for, and 2 granddaughters because my daughter was incarcerated. Also I exolained to them that I lost my home, sold most of my furniture to feed everyone and literally had nothing left.

I specifically spoke to Ernest Martinez and of course he was not sympathetic in the least. In fact he had the gall to tell me that there were people worse off than me. He was very rude and still 2 years later, he hasn't changed.

States that it is his job to do what he is doing and if I had taken care of my responsibilites, this would not have happened(Duh, ya think)

Anyway I told him that I only made $8.00 an hour now, and I could not afford to send in any money at this time.

So, what do you think that the firm did? They went to my credit union with court ordered papers and cleaned out my savings account, which was not mine, but my sisers money I was putting away for her care in case something happened to me. It was not my money to put away, but hers after she used what she needed for a month.

his reply was "too bad, theres nothing I can do about that. It wasn't fair to my sister, just because my name is on her savings account as well. I am the caregiver(representative) for her.

Then from there he sent me a pyment book to pay monthly on for two accounts. I misunderstood him and started to pay all the money on one account. He informead me that that was incorrect, but not after he arranged to have my measely paycheck garnished for 25% since I messed up the first order. Now I paid off two and I kept asking for the total amount I owed and they would not return my call  so I sent in  another payment. now i get a letter stating that my balance is paid off, but I overpaid, so they will just apply it to the next account. They know d**n well I need that money to take of my family, "BUT THEY DO NOT CARE"! So I am pretty much working for nothing and i don't eaaven get to call the creditors to see if I can work out some kind of a deal besides letting my family starve and do without!!!!!!!!!!!

I hope that there is an attorney out there that reads this and can try to help me get these people off my back.

I know I owe the money and I am trying to take care of it, but not at the expense of my sister and granddaughters. 

People have told me that they did not  have the right to conficate my sisters money even though it was in my credit union.Please send help!  I am  begging!!!!!!!!!

I am sorry to hear of your story but your not alone.  Machol is a debt collection milling machine and often has no idea of what they are doing.  First advice is to stop talking to them on the phone.  Deal with them ONLY in writing and keep every item including evenlopes with dates.  Submit all correspondence via registed mail.

Machol cannot do much outside the realm of the courts which are getting tired of all this third party ponsi sham case load that firms like mahol are unloading on the overburned courts.  But believe it or not, the courts are there for YOU TOO!  Understand that only you can be your best enemy for the behalf of this group of monsters.  If your served, perk up, stand up and if needed GET A LAWYER!  PRO SE defenses against them is not easy but I certainly enjoy it esp. when they send their bimbo freshly minted lawyers up for a run at it!  I truely enjoy eating them for lunch!  Some gov guys, no names mentioned, are getting really really upset at this bunch (the industry) in general and I think some new laws are on the way.

As for your sister.  Firstly, they must submit a garnishment order that can only be submitted in the shadow of a judgment.  Do you have a default judgment entered?  Then they must proceed forward with a writ of garnishment.  Now they will often send you a wavior of garnishment levy.  DO NOT RETURN IT.  Instead, make them go to court.  Now pay attention!  Your sister is disabled and in need of your assistance and the account is a joint account in both of your names.  This is called a convience account and is often used by elderly folks to pay bills.  THere are exceptions on garnishment for convience accounts but you have to prove it to the court.  Get all the bank papers together and show the court where the money came from and why it belongs to your sister.  You should also have on your person at a minimum a full durable power of attorney and a medical power of attorney in your name for your sister.  Often its one legal doc and easy to fill out.  But if your sister is not mentally there, you will need to seek help from the courts and seek a gardianship for her.  Again, its just route stuff as the courts will feel for your sister and try to help within the perview of the law.  There are lawyers out there who deal with part of family law.  Trying to argue with M&J is about as fruitless an exercise as pulling teeth on a chicken.

See what you can do in seeking more legal help.  Contact your court house and ask for any pro brono assistance and see if there are any pro se classes your can take and above all, keep trying.  Ask questions of everyone and dont loose your temper and dont use any four letter words.  Be polite, persistant and patatiant but but keep at it.  Use the internet as best you can.
