My husband was contracted by milling away to install corian countertops at all the starbucks coffee restaurants in the chicago and wisconsin and some indiana ares in total 105 stores. My husband completed they loved the work that my husband did for them.

Then (steve harvey) owner of milling away starts telling us he is not gonna pay the $7000.00 dollars that is owed to him because we had no ins, which he knew from the beginning and said it wouldnt be no problem at all.

Then when it's time for payment he states can't pay because contract stated we need own ins,and that starbucks had not paid him yet either, which I found out was a lie he got paid upfront for the job that my husband did and not only did he complete but he was also injured on the job too.

I contacted starbucks coffee and they said that he didn't know that milling away he contracted anyone else and that we had to deal with milling away since they hired us.

So you see my husband and I have had a lot of tribulations in growing up but all we are trying to do is provide for our 2 children and have somthing to show for all our hard work, to have a liar and a theif like steve harvey come along and rip us off.

We did the job 100% and everyone loved my husbands work even steve (milling away) but he still tried to scare us and then strong arm us about the law and contracts but he knew from the beginning thats he wasnt going to pay us. He used us to get paid well over $40.000 from starbucks and we got nothing unfair.

Please help. I would love for this story to go public so people can see how the big man uses the little guys for their own personal gain. Thank-you for listening.

Wow, you two must be swamped making all the products and finding the time to search the many responses on ripoff report!! What a joke! Stop hiding behind the name "Management". I thought maybe to just forget about the whole thing but not now. P.S. I don't need for you to instruct me on how this website works, thanks and I don't need them to stand behind me either, I have a judgment against milling away for that.

Everthing I said is true and it isn't slanderous if it is true. I have a lawsuit that I won against milling away and guess what, no one from milling away showed up at court! I was told by the Akron Courts that they did go bankrupt. Yes, I know the truth hurts and I have been contacted by others who have been stiffed by your wonderful company. Hey, why not sue me for slander and then I will be able to collect on my lawsuit from not getting paid. I still have the court papers and would welcome a response. Don't worry my husband is a construction superintendent for a big company and I will continue to spread the word on what a fine company milling away is.

We had hoped that Karen would be responsible enough to remove a report that is so erroneous with miss-truths in respect to the contractual arrangement of her husband's company and Milling Away, LLC but since she did notour response follows as below:

Milling Away, LLC entered into a contract with your company on 10/24/05, for the installation of Solid Surface Counter tops in various Starbucks locations. Our contract has some very specific terms and conditions that you agreed to and signed on 10/24/05. You seem to think you and our company should just ignore the terms and conditions, and we should in fact agree with any deviations to the same that you deem appropriate. Let's us review some of the same, as follows;

Ref: Paragraph #1, Completion Date
It was agreed in the contract, that the installation of tops would be completed by 11/25/05. In fact your final installation, was sometime in January. There were several site installations that you had tops for, that you did not install. We had to make other arrangements for the completion of the contracted project. Therefore you in fact did not complete the work 100%, and Milling Away was penalized financially for the same. You failed to meet an agreed upon installation and completion schedule. You also never returned all of Milling Away product for the project.

Ref: Paragraph #4, Authority
It was agreed that you would indemnify and hold Milling Away, LLC and it's Customer harmless against any claims, and you in fact filed a Worker's Compensation claim against both Starbucks and Milling Away , of which was inappropriate due to the fact that you were an independent contractor and responsible for obtaining Worker's Compensation on your own.

Ref: Paragraph #5, Insurance
Our contract is quite clear that no payments would be made until appropriate insurance was in place by you, which included; General Liability Insurance and Worker's Compensation Insurance. We repeatedly asked for the same both verbally and in writing, on numerous occasions. You promised several times to have the same in place but then failed to produce either proof of insurance (which you originally were suppose to have prior to starting any work). To date we have received neither, and you did in fact file a Worker's Compensation claim against us and our customer.

Ref: Paragraph #8, Compensation
We did in fact pay you $3000 on the contract prior to the completion of the contract, to try and help you through the project that was above and beyond the agreed terms. You had agreed that a portion of the funds would be used to put required insurance in place, and obviously you elected to use the funds for other means.

Ref: Paragraph #11, Independent Contractor
It was agreed that you were an independent contractor, and be responsible for any tax liabilities, including Workers Compensation. With you filing a Worker's Compensation claim against Milling Away, LLC and our customer, it is obvious that this also was not adhered to by your company.

Ref: Paragraph #22, Relationship
It was agreed that you would not contact our customer in anyway, including any type of third party. In fact this has occurred through direct contact with our customers as well as through your Worker's Compensation claim and aspects of the same. This has in fact caused Milling Away, LLC damages to its relationship with the customer. Further we had a confidentiality clause in the contract in regard to your relationship with Milling Away, LLC, which again has been obviated in your contact with our customer.

Ref: Paragraph #24, Contractor Agrees
It was agreed that you would be responsible for our products and any damages that may occur to them during your handling of the same. Thirteen damaged tops at a replacement value of $6800. You also did not return all Milling Away's product that was entrusted to you for installation. It was further agreed that if sub has any loss or damage that sub agrees to offset for the value.

Payments to Milling Away, LLC
Milling Away, LLC did not receive payment in full for product/services rendered for this project, due to the failure of your company to complete in agreed upon time fashion, and failure to complete the contract in total.

Payments to your company
We offered and sent final payment (in addition to the previous payments) on 11/15/06 via certified mail for what services were rendered, to what we know as your current address and the same was returned as refused.

To Conclude
You signed a contract of which; you agreed to the terms and conditions but did not adhere to, never supplied all of the documentation required and did not complete the work in accordance with the agreement.

I have a suit against them...

I was an employee of milling away llc and was not paid by steve or victoria. I took them to court and won a judgment against them but was unable to collect because I was told that milling away went bankrupt. Apparently they are still doing business. I have talked to attorneys but can't seem to get anywhere. Why is he allowed to continue to do business?

TIP: If you think you have a case... contact the prosecuting attorneys office near this companies address for some basic free advise...

thank-you all who gave feedback on my ripoff report however yes starbucks is responsible we were hired as sub-contractor in illinois that means that the orignal contractor are resonsible for insurance not us, my husband is a small business 5 employess max we just do small projects this was our chance to make a name for our co, and it backfired i guess, all we want is what is owed to us, so yes i think we will file a lien against milling away and starbucks thank-you

I'll bet $1000 to a dime that Milling will pay in a flash if you say the magic word. That word is "LIEN" Remodeled a Footlocker into a Christopher & Banks store and the contractor stiffed me too. Everyone loved the workmanship too. Soon as i told them I was putting a mechanics lien against the job they bitched and howled..AND PAID!! Your husband signed no contract with Starbucks so Lien them and you WILL get paid.

Why are you blaming Starbucks? They hired a contractor to do a job, then the contractor sub-contracted to your husband. Starbucks was correct when they said they couldn't help you.
