In 2005, My mortgage was held by First Horizon.  I fell behind by one payment with First Horizon.  I attempted to modify the mortgage and was told that I did not qualify.  They sold my mortgage to Nationstar.  I was able to catch up with the mortgage.  in November 2010, after being out of work for 8 months, I fell behind again.  I attempted to modify or refinance with Nationstar only to be told no.  In February, 2012, I was able to catch up.  In March, 2013, I was laid-off, but managed to pay the mortgage until June 2013, when my unemployment did not cover the bills in the house and my 401k funds had been exhausted.  Since then, I have tried to modify again.  Three times I forwarded the requested paperwork, and each time I was told, "They never received it."  Once again, I forwarded the paperwork to them and they agreed to modify the loan for three months at a rate higher then I was already supposed to pay.  If I could not afford to pay the current payment, they now expected me to pay more.  I declined the offer and have resolved that they are not a company that is interested in their customers problems.  I have suggested that I would take a deed in Lieu, and leave the property.  They informed me that they would not offer this option either.  I have reached the end of the rope with this house.  In the last month, they have added an additional 20k to the mortgage balance, with 15.00 a month being added for them to come to the house every month to see if it is still occupied.  They never leave any documentation that they have been there, so it appears to be added charges for invisible services.

I would also be interested in a class action suit against this company.

I routinely look for posts to answer in hopes that it will not only bring optimism to those homeowners and borrowers in distress but also some basic information to assist in fighting the banks that are "too big to fail" but yet don't appreciate the bailout that we provided in their time of need.  The debt collectors like SPS, SLS, Green Tree, Ocwen and Nationstar are simply just scumbags but they can be beat at their own game too just like the big banks can be defeated.  You CAN win this fight!!!

It pains me that you have fallen victim to the illegal, unfair, deceptive and abusive acts and practices of Nationstar since you have and have had for years a recurring and valid hardship but I also commend you for seeking help; too often homeowners do not fight for their consumer and constitutional rights!  With that said, you have overlooked a key aspect to your fight, which is putting it in writing in the form of a proper QWR and then to regulatory agencies outside of Nationstar that assist in fighting for your rights like the CFPB; the answers that you need and are seeking can be obtained from Nationstar’s via QWR responses when pressed.  I would be more than happy to educate you as to how to fight for your rights.  My firm routinely seeks out complaints online so that we can educate as to how to fight back on our weekday show called "The Daily Complaint" where we review a complaint and how to tackle it successfully.

Let me first point out that Nationstar has violated your rights by denying you a "Fair Review Process" as afforded you under the CFPB and RESPA (Dodd-Frank).  Also, Nationstar has violated a plethora of Federal consumer protection laws afforded you under the CFPB and Dodd-Frank to include the “No Runarounds” mandate implemented this year on January 10, 2014.  You can learn more by visiting the CFPB's website and learning more about the rights afforded you under the FDCPA, Dodd-Frank and RESPA via the CFPB – click here

Obviously, you are an idiot.  According to the Obama administration, it is up to the mortgage companies to try and refi or provide a HAMP or HARP modification for those who were affected by the recession and have fallen behind.  And if you had read my complaint, I did not sign my mortgage documentation with Nationstar.  My mortgage was signed with First Horizon.  Nationstar is in the business of buying loans that have fallen behind because they will most likely end up with the house and the opportunity to sell it.  In addition, when I tried to short sale this house, the realtors stated that in the current market, my house is worth 80k less than what Nationstar says it is.  Therefore, a short sale is also out.

I am not trying by any means to rip off any one.  I wanted the same fair shake that many other hard working Americans (and the banks) have received.  i am a single parent and often worked two jobs to make sure that the mortgage was paid since 1997 when I bought the house.  That should say something in itself.  If I had not lost my job by being laid-off, and the job market in that area not drying up, this would have not happened.  So until you walk in my shoes or the shoes of another single mother, raising three childen, FO.......

 Why would you even bother with a class action suit? YOU have NOT been ripped off. YOU seem to be under the impression that the lending entity MUST give you a REFI. They DO NOT have to do it and them sticking to the terms of the original loan is WELL within their rights as the loan holder. While I commend you for falling behind and catching back up, I find your post to be nothing but a whinefest. You are basically whining and crying online because THEY are holding you to the terms YOU agreed to. YOU signed the loan paperwork. THEY are under ZERO obligation to give you a refi. It is NOT their job to "care" about YOUR life and personal circumstances. You are expecting more out of them then even YOU would be willing to give. If they DID give you a refi and they couldn't justify that action, well then SOMEONE is going to lose their job. Be honest here, would YOU give up YOUR job? Would you WILLINGLY sacrifice the security of your family and home to do an act that you KNOW would get you fired?? So now that you have answered the question, you can see WHY they wont work with you. What you are crying about is them sticking to the original loan request terms and conditions. It IS their right to NOT modify the loan. Your ONLY course of action is to pay off the loan. YOU have NOT been ripped off. YOU however ARE attempting to rip THEM off.
