Nuvell Finance Co Repoed my 2005 Hyndai Elantra claiming I had to come up with $1500.00 to get the car back within 15 days. Had money less than 7 days to pick up car. Car was already sold! Internet, Internet

In 2005, I purchased a new 2005 Hyndai Elantra, loaded. It had 25 miles on it. I put $2,000.00+ down and drove off the lot happy. In 2008, I began to have financial difficulties due to a decrease in finances. I tried to refinance to lower my payments, but they claim because I was behind payments I couldn't. Finally I was going on third payment arrears, they repoed my car at 4:00am, 12 days before Christmas! Told me I could get the car back within 15 days if I came up with $1,500. I came up with the amount within 5 days and called. They told me they already sold the car! Not only did they get a car that only had 36000 miles and in perfect condition (new tires, full tank of gas and a $30 chrystal ball on the mirror, they probably received a good price for the car by ripping off someone else and a former dissed customer who will never deal with them again. A month after that their town suffered a very bad Hurricane. Hmmm, coincidence? Pinky, Lawrenceville, NJ

It is always amazing how people can't make their payments because of "financial difficulties" yet once the lender repossesses the car they by some miracle are able to come up with the money.  You were probably like everyone else who thinks "Oh they will never repossess my car".  Just how long did you think they would let you drive around without making your payments?

Well I will tell you that if they waited until your THIRD payment was in arrears that is about standard.  Just about every lender will repossess your car by the 90 day mark.  But some lenders may give you significantly less time.

Don''t think your issues are not over.  They buyer at the auction may have gotten a "good price", but that is "bad" for you.  Because the auction price is going to be significantly less than it's value(and the loan balance).   If there is a balance on the loan you will still owe on the loan even though you no longer have the car.  If you didn't have a balance consider yourself very lucky.

With all of that said, States do have very strict laws that govern repossessions.   Depending on the state and situation they may have been able to sell it at 7 days, regardless if they "told" you 15 days.  If they did not follow the repossession laws of your state you may have had some recourse.  The problem with that is that it is now 2011 and the Statute of Limitations for any claims may have already passed.
