I inquired about a Loan Mod with Ocwen back in April 2008 and submitted my paperwork (via certified mail) on April 25th.....I was told it would take 15 days to process. After countless phone calls to their "Customer Service Number" which is in India I finally received the Modification Agreement @ 5pm Friday, June 20th. The agreement stated I had till June 25th. to sign and send back with my down payment. I noticed right away there was some very vague language in the agreement. The first item was in the cover letter and states:

NEW MONTHLY PAYMENT: $2,542.59
(which may or may not include escrow)

Second item was in paragraph 3 which states:

"Any payments due for taxes or insurance will be your responsibility in addition to the payments of principal and interest required under the terms of this modification."

I called OCWEN to go over the agreement and asked if my taxes & insurance were included in the monthly payment. Anthony in Bombay assured me the taxes & insurance were in fact included in the payment. Great!! I told him that there was an error in the cover letter and in paragraph #3 that stated that they were not included and asked him to please correct the error. The answer I got was astounding. Anthony informed me that this was their standard agreement that had been approved by the legal department and COULD NOT BE CHANGED. I asked him why he was telling me one thing on the phone but the agreement clearly states otherwise. Anthony informed me (in a very threating manor) that if I did not sign the agreement "as is" that OCWEN would put my home in foreclosure. Which they ended up doing 2 days later.

The next item I inquired about was paragraph 9c that states:

"Any expenses incurred in connection with the servicing of your loan, but not yet charged to your account as of the date of this Agreement, may be charged to your account after the date of this Agreement."

I asked Anthony what "Any Expenses" were and he informed me that was "legal fees and stuff". I told him I thought that term was very vague and asked if he could be more specific. This inquiry seemed to irritate him emencely. Again I was informed that this was their standard agreement that had been approved by the legal department and COULD NOT BE CHANGED....along with the standard threat of foreclosure.

I feel I'm being forced to sign a misleading agreement that does not reflect what I'm being told on the phone. Aside from hiring an attorney (which I can not afford) what can I do??

Ocwen Sucks

I did a loan modification and it was finished on April 1th 2009 they give a three month trial period which I did from Feb.
After April I noticed these fee's appearing on my statement, first a $103 dollar home valuation then a 39 dollar record fee and then this month a 300 dollar sale cancel fee

here's the response they wrote to me, buyer be ware of the fee's they assess after the loan mod !


Ocwen would like to take this opportunity to thank you for your recent communication regarding the above referenced loan. We appreciate
the time and effort on your part to bring your concern to our attention. Pursuant to your concern, we have reviewed the loan and below is
the recap of our response to the concern raised:

Concern#1 You requested us to provide you with an explanation for the cancel sale fee assessed to the loan.

Response
A review of our records indicates that foreclosure proceedings were initiated on the loan on July **, 2007. However, the
foreclosure proceedings were stopped on April **, 2009, as the loan was brought contractually current through modification.
During foreclosure proceedings, there may be fees incurred which will be assessed to the loan on a later date. Therefore, on
April **, 2009, cancel sale fee in the amount of $300.00 was assessed for cancelling the Lis-Pendens, vacating judgment and
cancelling our pending action. Please note that the cancel sale fee assessed to the loan is valid.

DO NOT ACCEPT OCWEN'S LOAN MODIFICATION AGREEMENT **

On March 12, 2008 I signed a "loan modification" agreement with OCWEN thinking it was the only way to save my home, they claimed to have sent it by mail but I never received it so they faxed a copy to me. It was dated March 6th 2008 and stated that the loan modification agreement offer expired on March 10th 2008, ( the fax was received on March 11 2008 by me) I was told they could not change the dates but they would honor it if I sent in the $9102.00 by March 12th 2008 (via wire transfer or Western Union) or my house would be sold at public auction. Not knowing what else to do I sent the $9102.00 via Western Union and signed the loan modification agreement and sent it also.
I asked OCWEN to send another copy of the mod. agreement to me because the 1st copy they sent was very dark and difficult to read. The re-sent it and this time it was clear but I noticed the probationary period (for the next 2 months) had gone from 3404.08 to 3808.64 !!! With all of this agreed to I thought all was fine. WRONG!!!
I recently discovered that OCWEN sold my house on March 18th (6 days later) and never thought it necessary to notify me of the sale!!!!
Pulling county records the sale took place on only 6 days after the mod. agreement and later rescinded. As per the mod. agreement I paid the $3808.64 probationary payments required by phone, they did not tell me that the agreed to amount had changed and my statements ( i get at least 4 every month with different dates they were generated all with different info on them) showed that OCWEN had received the payment but the next day the payment had been reversed out and put into a "suspension account" (WTF is that?) to shorten this up they had received all monies agreed to but put them in a "suspension account" and had not applied them to my account, until June 16th they applied all monies sent in to my account. On June 24th they filed for a notice of deed of trust sale which was recorded with the county on July 7th that the sale would take place on July 22nd. My family left on July 3rd for summer vacation and when we returned on July 22nd I walked into about 10 letters 6 of which had all been mailed on July 15th!!! apparently my house did not sell at public auction but to a 3rd party bidder that OCWEN had lined up to purchase it for 100k less that what we owe on it. OCWEN does not allow short sales any longer.. unless it is them that handles the short sale after your home has gone into foreclosure this is done so they avoid incurring the amount of the difference and it is passed on to the note holder that they are working for as a "middle man" between the homeowner and the note holder (wonder if the note holder is aware of this business practice by OCWEN). At this point I am now awaiting a court date responding to Unlawful Detainer (eviction) papers that have been served to me and I have all the proof that I met my responsibilities required in the "loan modification" agreement but OCWEN blatantly misappropriated funds and stole my home from me !!!

If i want to stay in my home I have to file a lawsuit against OCWEN (more $$$) or move out now and uproot my families lives and wait to see what happens in this class action law suit. (we will be renting and in limbo until that time)

I know I am not the only one out there that this has happened to but I can tell you I am so frustrated and discouraged that I have lost my home and there wasn't anything I could do about it because I am just a peon...
I hope that in numbers via this class action law suit OCWEN will be held accountable and that there will be enough of us in the class action law suit that OCWEN will be the peon that gets destroyed!!!

The point is save your money and don't sign the loan modification agreement because they are going to find a way to take your home away from you anyway!!!

I am just a mom trying to provide a good home for my 3 sons, I have no financial assistance from anyone including my ex husband (who has not worked in over 3 years and is living with his mother) but I will not give up and will participate and help however I am able to in and with this class action law suit.

I think I know why Ocwen is doing this

Everyone I've talked to about this is dumbfounded as to why Ocwen will not correct the errors in my loan mod so we can move on. It seems they would rather keep pushing the home closer to a forclosure sale while it tacks on thousands of dollars in outragious fees. NO more short sales and don't try to give them back the house...they won't take it (I tryed).

I read that a few months ago Ocwen was in negotiations for a buyout of the company that ultimately failed. Now, if you want to make your company attractive to a buyer, one thing you need to do is show them how much money you have coming in, or that is owed to you...ie. your accounts receivable report. If Ocwen can continue to rack up millions of dollars of fees onto their customer's loans this boosts their accounts receivable report. Which, on paper, looks like they will be having a lot of funds coming in. So now they can take this BS document, show it to an investor and say "see were a safe bet, we have all this money owed to us". It's the old Figures Don't Lie But Liars Can Figure approach. If they can't find a foolish investor to buy them I have a feeling they will take the same road as Countrywide.

In the mean time they're screwing up people's lives and destroying the economy in the process.

WTF?

Is it possible your attorney would be wiling to take the rest of us and file a class action suit? I have searched high and low, but cant seem to find an attorney willing to take them on, also I dont really have money to pay an attorney especially given that I dont know how long a suit would last. However, there may be a light at the end of the tunnel after all. I did hear on Larry King last night that the Floriday Bar Association has started the FLASH (Florida Attorneys Saving Homes) Program and since Ocwen is in FLorida, maybe we have a chance and its PRO BONO! Please let everyone know about this program, if we bonbard them with emails and phone calls maybe we can get some action going!

Ironically I got the same agreement and asked the exact same questions and got the exact same response. They sent the agreement via certified mail and charged me for it, made the payment date for two days after I received the letter it was for the month that had aready passed, so I was already a month behind when I signed the agreement, and when I crossed out the ambiguous language they refused the agreement and told me I no longer qualified for the program. Go figure???? According to Ocwen and my credit report, my mortgage has been late 30-60 days since 2002, mind you I got the loan in October 2002 and Ocwen obtained it in March 2003. The idiots at these finance companies for some reason believe anything they see on a credit report regardless of what you tell them even when you have proof, so now no one will refinance my loan, I cant even get a car with a trade in. Thanks a lot Ocwen. However, not with my approval, but my husband for whatever his reason insists on paying Ocwen and "trying to save the home." I say good riddance to Ocwen and their house. Let em foreclose, our credit is already ruined and will continue to be because even though we are paying them every month, because one month is in arrears they keep adding late fees to the present month and reporting us as paying late when the forebearance agreement was supposed to make that payment spread out over 12 months back into the loan. So our payments are actually on time, or so thats what we were told when we sent them the $3000+ down payment, twice!

Here's the kicker. Along with trying to force me to sign an agreement that does not reflect what I'm being told on the phone (re: taxes & insurance and the "Any Expenses" clause) they also want me to give up my rights to any recourse!!


Paragraph #11

BY EXECUTING THIS MODIFICATION, YOU IRREVOCABLY WAIVE ALL RIGHTS TO A TRIAL BY JURY IN ANY ACTION, PROCEEDING OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THIS MODIFICATION AND ANY RELATED AGREEMENTS OR DOCUMENTS OR TRANSACTIONS CONTEMPLATED IN THIS MODIFICATION.

I contacted them again today and was told I could talk with their attorneys regarding the Loan Mod. I was given a number for Financial Default Services...which I called and was informed (by Doug) that they were the title company servicing the loan for Ocwen and could not help me with the Loan Mod.

This is totally insane!!

You refer to Ocwen as knuckleheads--also add idiots to the list. I have battled Ocwen since 2002 and they never cease to amaze me. I have managed to beat them so far but have had attorneys helping me all of the way. I cannot even imagine fighting Ocwen on my own as they viciously take advantage of the homeowners. My last round with them resulted in me hiring an attorney in September 2007. They know I am represented by legal counsel that presents a major problem for them. But they continue to call me everyday trying to harrass me from the loan resolution department. My lawyer told me to have NO contact with them period. Do no talk to them on the telephone for any reason. They do not have the balls to call my lawyer and bother him with their fraudulent negotiations. So I just document all phone calls from them and save the recordings from Ocwen and these will be used against them.

Ocwen is powered by corporate greed. They will try every mortgage servicing scam there is. They are totally fraudulent through and through. You cannot fight them on your own. They will even try to ignore your attorney. A good attorney is the only weapon that is effective. Ocwen will try to foreclose as fast as they can on any homeowner so do not trust them at all. I would never sign a loan modification agreement with Ocwen for any reason. It takes the homeowner's right to sue Ocwen away and lawsuits are the only way to get their attention.

I cannot express the hate I have for Ocwen. You cannot reason with these people and certainly cannot believe anything they say. I advise sending a Qualified Written Request to Ocwen so they have to send you copies of all of your documents in their files. Have a forensic loan document review done as any loan serviced by Ocwen can contain many legal violations. Go to www.loansafe.org and get more information and educate yourself on how to fight Ocwen back. The helpful Loansafe advisors are not lawyers but can advise if they think you need legal counsel. Good lawyers are affiliated with their website and can be hired to do a forensic loan document review. TILA and RESPA violations are common as well as predatory lending issues with these bad mortgages.

As for Ocwen loan modifications, I have read many reports where they agree to modifiy the mortgage for the homeowner but then do not change the interest rates or terms after the homeowner signs his rights away in their crooked agreement.

Hire an attorney and give them Hell--I speak from experience. Go after them for any mortgage servicing violations with a vengeance. You are dealing with some real crooks as this is a sorry company.

I cannot express the hate I have for Ocwen. You cannot reason with these people and certainly cannot believe anything they say. I advise sending a Qualified Written Request to Ocwen so they have to send you copies of all of your documents in their files. Have a forensic loan document review done as any loan serviced by Ocwen can contain many legal violations. Go to www.loansafe.org and get more information and educate yourself on how to fight Ocwen back. The helpful Loansafe advisors are not lawyers but can advise if they think you need legal counsel. Good lawyers are affiliated with their website and can be hired to do a forensic loan document review. TILA and RESPA violations are common as well as predatory lending issues with these bad mortgages.

As for Ocwen loan modifications, I have read many reports where they agree to modifiy the mortgage for the homeowner but then do not change the interest rates or terms after the homeowner signs his rights away in their crooked agreement.

Hire an attorney and give them Hell--I speak from experience. Go after them for any mortgage servicing violations with a vengeance. You are dealing with some real crooks as this is a sorry company.

I am having the same problems with these knuckleheads, only they said I do nto qualify for a loan modification because I make too much money. They are so ignorant. I have contacted my congressmen and have already rec'd a call back and was referred to a website that you can make completes to. I have already done that and I have contacted an attorney who has indicated he has had issues with Ocwen, but has not has any luck negotiating with them so he is suing them. Looks like a class action lawsuit may be the answer. I am hearing waaaay too many stories that are the same in regard to the loan mods.
