This complaint listing has only just been brought to my attention by a Google search. Unfortunately without the customers full name or the VIN# of the vehicle involved I have no way to look up the specifics of this case. However I can state the following:

1) All vehicles we sell are sold legally conforming to all relevant DMV regulations in the state of California. We have been licensed and bonded dealers for over 15 years. Our dealer # is 26005.
2) We have been trading on Ebay Motors for over 5 years and have 100% good feedback. (Lookup Ebay user "ocpabi_sales") We have over 400 positive feedback from real customers, many of whom buy their cars sight-unseen based purely on our description and are delighted. We cannot achieve this if we are selling vehicles that are not in excellent condition.
3) We do provide free Carfax or Autocheck history reports for all our vehicles and guarantee that the title is clean. However no computer history report can ever be 100% accurate. We never sell vehicles that we know have major damage or issues and all customers are free to arrange an indepened pre-sale inspection on any of our vehicles. This is clearly posted in our offices.
4) All used cars are sold "As Is" under California DMV regulations and all customers sign a contract agreeing to buy the vehicle "As Is". If the customer does not understand the implications of such a contract they need to discuss this prior to the sale and signing the contract.
5) The original posting makes no mention of making any effort to have us remedy any of the issues. If there is something that we can do to help for an issue we were not aware of at the time of sale we are always willing to try if give the chance by the customer within a resonable time frame.

But in Ga, the law is on the side of the dealer/seller in a transaction for a used car. All used cars are sold As Is. That means that if you buy a car used and it turns out that the engine and tranmission needs to be replaced, if there is no written agreement stating that the dealer/seller will warrant the vehicle, then they are not liable for one red cent. Not saying it is right or fair. Just the facts. Now with that being said, the dealer/seller must state on a decal (usually a window sticker) tht the car is being sold as is and with no implied warranty. If the state dept that regulates the dealers catches cars on a lot with no sticker, there are big fines possible.

Now having said all of that, you mentioned that the carmax report failed to disclose an accident that had not been reported. What did your inspector/mechanic say prior to you purchasing the car. If you had it inspected and they failed to notice the accident, then you may have a case. If you did not have it inspected, you skipped the most important step in purchasing a used car. An independant inspection would have only cost you about $50 to $100. They would have been able to tell you any problems that the car might have. A very cheap insurance policy. Never rely on just Carfax. A good suppliment, but not a science.
