I rented a motor vehicle from HERTZ RENTAL CAR out of Chicago Ohare. Hertz have an agreement with PLATE PASS (the toll operators for the toll roads in IL). I elected NOT TO USE THE PLATE PASS ELECTRONIC DEVISE and DID NOT use the express lanes opting to pay CASH at each and every toll booth. HERTZ gave me the option NOT to use the devise, and disarmed the devise removing it from the windscreen.

Otherwise I was informed I would be charged some $2.50 per day just for using the devise once!

My wife and I paid cash at each and every single toll booth and we NEVER used the electronic pass.

Plate Pass however are now attempting to collect a monthly service fee in addition to toll fees that we had paid in cash.

The devise was not operative, or so we were informed, and had been placed in the glovebox of the rental car and out of site.

I have contacted Plate Pass and they refuse to co-operate. I have asked for evidence from them that we used the devise, or the express lanes, in the form of either data recordings, photographs, or any other form of evidence. They have not provided such evidence other than an invoice.

This is a fraudulent scam and although the amount is slight, it is the fact that it is clearly a fraudulent act that makes me so completely irate. I will be taking this matter further.

Since investigating this, I have found thousands of other cases whereby Plate Pass, and other toll operators have used the same tactics to reel in huge profits from duplicate toll fees and additional charges they had no right to charge.

Hertz Plate Pass

The manner in which Hertz and Plate Pass deal with EZ Pass tolls is very troubling.  It is one thing to offer the convenience of an EZ Pass, particularity given often very long lines at cash lanes.  However, it is unconscionable to hide the fact that there are charges and fees above the tolls charge, and it is hard to escape the apparent conclusion that Hertz and Plate Pass set up the whole process so that consumers do not notice the charges until long after the rental is turned in (if at all).  Meiselman, Denlea, Packman, Carton & Eberz, P.C. is actively investigating a potential class action against Hertz, Plate Pass and other rental cars companies that charge hidden fees for electronic toll transponders.  If you would like to discuss your legal options, please do not hesitate to contact me:
