We own a condo in Florida that we rent out. The hot water heater burst and caused damage to apartments below us. Our maintenance company, Pride Air Conditioning & Appliances sends us statements each year reflecting the age of the appliance. The hot water heater was always listed at less than 15years old. It turns out that it was over 30 years old and totally rusted out.

We would like to sue Pride for damages to our condo and payments we had to make to insurance companies of the other apartments. We did not have home owners insurance at the time. We were under the misunderstanding that the fees we paid to the association that manages the complex included insurance. It turns out that it only covers insurance to the outside of the building. We purchased the condo in 2010. The prior owner used the same maintenance company for many years.
