Publishers Business Services called my home in Fairfax, VA in November 2003 asking if I would participate in a short survey. After completing the survey they said they would award me with 5 free magazines of my choosing and all I would have to do is pay the shipping and handling for the magazines.

I thought their purpose of the call was to do a survey, but it turned out to be a magazine sale. PBS did not disclose truthfully and promptly their purpose for the call, which was to sell magazines. The sales representative on the phone said that I can try these magazines on a trial basis, and if at anytime I want to cancel I would be able to. I told her to send me more information to my home address and she then asks me if she can record our conversation in which I will give them permission to send the information to my home address.

In the recording she tells me in a very fast paced manner the shipping and handling is $29.90 a month for two years. Trying to hurry up and get them off the phone, I say yes to all their questions, not knowing I was entering a verbal contract. According to the FTC's Telemarketing Sales Rule it requires sellers and telemarketers to disclose the total costs to purchase, receive, or use the offered goods or services. PBS never told me it would cost me a total of $717.60 for all these magazines to be sent to my house. Wanting to get them off my phone I hang up as quickly as possible thinking I would get more information in the mail about the offering.

I later find out after receiving a bill to my house, and a phone call from an accounts receivable person that I agreed to a non-cancelable clause in our verbal contract. The FTC's Telemarketing Sales Rule prohibits sellers and telemarketers from misrepresenting any material aspectone that would likely have an effect on the consumer's purchasing decisionof the nature or terms of the seller's refund, cancellation, exchange, or repurchase policies. If they made it clearly known that I was agreeing to a non-cancelable contract and that I would have to pay a total of $717.60, I would have NEVER agreed to this trial offer. I agreed for them to send me more information ni the mail about the offering; I never agreed to a contract. The act says, Sellers and telemarketers may disclose orally or in writing information about material restrictions, limitations, or conditions to purchase, receive, or use the goods or services being offered, as long as the information is clear and conspicuous and disclosed before the consumer pays. Their non-cancelable contract and the total cost of the magazines were NOT clear and conspicuous.

On the phone, the accounts receivable person threatened me by saying that if I didn't pay my bill she would send me to the collections office. I told her to cancel my subscription, and she says it's a non-cancelable contract and I can't cancel for another 180 days. She offered me a business discount in which I could pay a lump sum of $358.80 up front and that would give me a 2 year subscription to the magazines rather than 5 years. I told her that I didn't have a business and she said I can just create a name. I didn't think this was morally right and told her I would speak to my lawyers, and if they were going to send me to collections, they should start the process now because I wasn't going to pay for a bill I never agreed to.

Since I've never paid their monthly subscription fees, they have been harassing me and annoying my family and me by repeatedly calling my house number everyday and sending me bills once a week. The Rule according to FTC's Fair Debt Collections Practice Act prohibits sellers and telemarketers from engaging in certain abusive practices that infringe on a consumer's right to be let alone. The Rule's privacy protections include prohibitions on: causing any telephone to ring or engaging any person in telephone conversation repeatedly or continuously with intent to annoy, abuse, or harass.

Publishers Business Services falsely claimed the magazines were a trial and that I would be able to cancel at anytime. They also failed to include an official notice of cancellation or inform me in writing of my right to cancel, and connived me into agreeing to a non-cancelable clause in their contract. They engaged in false and deceptive tactics to promote their magazine sales, and engaged in intimidating tactics by harassing me with multiple phone calls a day.

As posted in another post.

(((let me add that your accounts has been resolved, and as you say your getting free magazines. if you are unsatisfied with your account email us or call. we will resolve the problem. we have 1000s of customer that are happy with there accounts. As in any business your going to have unhappy customers. if we can not make you a happy customer your account will be resolved)))


There is a 3rd and a 4th step that is done before a lead becomes an Order.

The 3rd call is tape verified. At this time the order is gone over , and credit information is taken. We do this step to make sure that the order is understood, and at the end of the conversation we ask if the customer has any question.

4th step of the process we send out the information in writing . We wait ten days before we process the order. Even if we receive a letter/email after the ten days, and the customer has a post mark with in the ten day we cancel the order.. If the account has been processed the customer ends up with magazine at no charge.


Any customer having a problem with there account should call 1-800-949-2271, and ask for customer service. There job is to solve the customers problem. If they can not help you, you need to ask or call back for the customer service supervisor.

I'm sure that every complaint here has been solved. If not please respond and we will make sure that your concerns are answered.

As our website states We guarantee 100% customer satisfaction if you are completely unsatisfied with your account it will be resolved.. This process takes time, but it will be done. Again I'm sure that every complaint on here the customer account was resolved, and they are still receiving magazines. If this is not true email us, and we will respond.

Can't believe this company is still in business.....

This company ALWAYS calls people at work. I have read thru almost every report on them here. I, too, was almost a victim of this scam company. They called me at work, and being at work--knowing people will say yes to get them off the phone-- I agreed, but never paid a dime. I got the paperwork and just about fell over. I got the line too, that it was non-cancelable. I wrote them a 3 page letter outlining why it was a scam and if they didn't cancel my subscription, I'd call the BBB. They canceled my account. I am still getting the magazines after 2 1/2 yrs. I assume I am getting them for the full 4 or 5 years. Only problem is, they're magazines I don't even read. I'm selling them on Ebay, LOL.

Everything has been resolved

Since the sales call happened in VA, I got in contact with the Commonwealth of Virginia's Dept of Agriculture and Consumer Services. I filled out one of their complaint forms and transmitted my testimonial about what had happened between me and Publishers Business Services. They wrote a letter with the main contact person there and was able to get everything resolved. PBS wrote a letter letting me know that they dropped my account and although I might be receiving the last few months of my magazine subscriptions, it would be free of charge.

They did reiterate that I had fully understood what I was signing up for and that they had tape recorded everything. Their story is complete BS, but it's okay since I won in the end. I get free magazines and they lost money.

I suggest that you contact your state Consumer Affairs office and file a complaint. There is a specific form you need to fill out. Once that's done, they'll do all the work.

I was contacted at my place of work. A doctor's office that is extremely busy. I was busy, they knew it and started there spiel and I was sucked in. They also called me the next day to confirm the info...again busy, busy, busy. They were quite rude when they told that there was a non-cancellation policy. I didn't think that was legal. Due to dental work I don't have the finances, so I have e-mailed them tonight to see if they will cancel. We'll see.

I need suggestions

I have already sent this letter to the Consumer Affairs Office in my home area. I plan to e-mail the company directly to resolve this issue personally, but I need suggestions on what I should say to make this an effective letter. If there's anyone out there who can help me figure out what to say. Please come here and post your suggestions below.
