He started on March 3,2005 and stopped on May 2, 2005because i wouldn't pay him the remainder until finished which was stated in the contract and also wanted 1800,00 more then what the contract stated so i didn't pay him and he stopped the job and i have not seen or heard from him since.

I signed a contract with Richard Zywarski on Feb. 28,2005 for remodeling my bathroom. He said it would only take a week to finished the job. Now it is May 13, 2005 and He is still not finished. He has constantly been putting my job aside to work on his other customers jobs. I had paid payment as follows:Feb. 29,2005 1,600.00 to sign contract March 21,2005 600.00 for plumber and electrican license use for village permit. March 23 150.00 for a fan and light combanation.

April 2 500,00 April 13 1000.00 My problem is this: As of May 2,2005 he has not been back because he asked for an additional 1800.00 and i wouldn't pay it because he is not finished. he said that I wouldn't have to pay him any more money until he finished the tile which is not but half done. he told me when he started it would only take him a week to finish but throughout the past 2 months he was only her total about 50 hours because he would only come some weeks 1 or 2 days a week only the first week he was here all week and it took the Richards hire hand to do only a portion of the wall tile in 25 hours. The contract states: We hereby propose to furnish the materials and perform the labor necessary to completion of Remodeling bathroom. I Evelyn the customer purchased all the materials tile tub toliet sink paint lights which costed 3500.00 dollars. The contract also states: payment as follows:1600.00 when sign contract 1000.00 half way and balance upon completion Acceptance of Proposal.

The above prices specifications and conditions are satisfactory and hereby accepted. You are authorized to do work as specified payment will be made as outlined above. then we both signed .

He won't finish the job till i pay him more money and i refused What should I do? I am very upset on this matter and would like all my 3850.00 back plus lawyer fees and court costs and heartack and aggravation and any other fees involved Mine you I only have One bathroom could you keep me updated on my report via my e-mail and phone Thank you for your help
The money i paid them was only for LABOR

Sincerly,

Evelyn
