I was not even aware that they horrible people bought the loan from roadloans.com. I had to find out by viewing my credit report online. From Oct-Dec 2009 I was getting over 8 calls every day from these people. They harassed me to no end. I am a survivor of DOMESTIC VIOLENCE! I was forced into cosigning for a car that I did not want in 2004. I signed under duress, and fear of what my now exspouse would do to me. That was the WORST mistake (second to being married to an abuser). After he threatened to STAB me in July 2007, I started to get help. I moved out in Jan 2008, and filed divorce. The judge ordered him in stipulated judgement to get that car refinanced into his own name. Well, 2.5 years later, this loan is STILL on my credit reports. It is being reported late.

I never ever got any statement in the mail to notify me this loan had been bought by santander. They refuse to send me any documents about this car, because they told me I was not the primary borrower. I have called them several times recently to try to get them to remove that account from my name, and my credit reports. I faxed all court documents, and even mailed them two copies certified mail over 8 months ago. Last week they reconfirmed receipt of all documents. They refuse to take my name off the loan. I have no idea where the car is. I have not seen it in nearly 3 years now. I had to move 100 miles away just to be safe. Santander will not return my calls.

They claim I am responsible for $19K on this car. Yet, I have to see one statement. They will not delete it, and could care less if my life was in danger. They just told me "oh well, you signed a contract." I am not even the registered owner of this car. The contract I was forced to sign is not valid, and needs to be cancelled. I just want my name, and my credit protected from that batterer who tried to kill me. He is dangerous, and I do not deserve to have my credit ruined indefinately until he finally sells it. It is NOT MY FAULT, he is not paying them on time. They have no proof of non payment either or late payments, at least none that I have seen. Where is the justice for women who were abused, and had to start over with literally zero?! Per court documents, I am NOT responsible for that car. PLEASE HELP!

I will be filing complaints with Dept of Cosumer Affairs, BBB, Federal Trade Commission, and CA & TX Attorney State General offices, and the FBI in Dallas TX. I suggest everyone else do the same. The more complaints the FBI gets, then maybe those JERKS will finally get shut down, and brought to justice! I want this company brought to justice, for violating my rights under the Fair Credit Reporting Act, and Fair Debt collection Act. For what it is worth you can call some lady name Cynthia (cindy) at Santander, she claims to be a manager. 817-605-4978. Harrass them, and see if any results are made. Dont bother wasting your time on worthless customer service reps! They KNOW NOTHING & DO EVEN LESS! Also Kasey Goodman is self proclaimed Vice President of Santander: his number is 214-261-1615. lets all unite together, and SHUT THESE PEOPLE DOWN! Will some nice lawfirm PLEASE HELP US!? There at least 1000 people in need of HELP!

Thank you Steve for your wonderful advice.  The ONLY reason for using the Federal Trade Commision,the Attorney General, and others was to Bring Attention to this company.  I work for the government, which is a great paying job. Guess what? They don't like people who are honest or quiet; but it's all good. No place is 100% where you work, I get that but to be outright dishonest in your dealings is another thing. 

 

I already have a lawyer, since I know a few due to my position with this government agency.  Again, filing complaints with the above mentioned parties was simply about putting Santander on the map more for the public; since most don't keep up with lawsuits. When I came to this forum, there was a another guy who mentioned that Santander was involved in a ponzi scheme.

I will do research on this, just to find out if it is true or not.  Steve, you are truly a precious jewel and I appreciate you. :)

But, I do thank you so much for your advice.  I just have a concern, for people who might not be getting paid so well at their jobs; and have to deal with an evil company like this.  JESUS has really blessed me to make it through. Again, stay encouraged everyone and have a Merry Christmas!!!

- Umm...one of their addresses is

P.O. Box 660633 Dallas, TX 75266-0633

- First 666 is not together and I don't know where you got the extra 666 at the end, second that is based on the Zip Code that is issued by the US Postal Service.  So if we take your logic to the next level I guess you want to say that the government is Satan also. 

Not to get off track, but I did just have to give you credit that that could be one interesting thought.  After all the White House is at 1600 Pennsylvania Avenue, so if you take out those 00's and change them to 66 you get 666 as well.

Advice, and education for Miss Bana

Miss bana,

It appears that you are truly confused about a few things.

The first advice I need to give you is to leave your religious drivel at home. Jesus cannot help you. This is not the forum for religious drivel.

Second, the FTC does not do any legal enforcement of your rights. None. They do not have the jurisdiction, or purpose for that.

Third, The Attorney General will not represent you individually, as that is not the purpose of the AG. No jurisdiction. The AG represents and advises government agencies.

Fourth, the FTC administers the FCRA and the FDCPA, but the FDCPA only applies to THIRD PARTY debt collectors. Santander is a "lender" and is exempt from the FDCPA rules.

Therefore, your entire post served no purpose at all to anyone.

Get some education, and a reality check.

Just wanted to say GOD Bless and keep you! I have been dealing with this evil company now for an year!! It is simply unreal how they treat you! My old loan was with Drive and everything was fine. Then all of sudden; I am getting Double Billed with triple the interest! Look @ the name closely! santander(satan) their address is :

I to have filed a complaint, with the Federal Trade Commission. I am going to file a complaint with the Attorney General here in California! Stay encouraged; cause I really believe this evil company will be shut down. Maybe we should call CNN as well, to bring more attention to this matter.

Leaving your husband was a heroic thing to do - and ultimately the first step to rebuilding your life. It sounds like you have come a long way and now you are there to help others out of the same type of situation. Kudos to you!

Unfortunately, when you co-sign any contract, with anyone, a divorce does not 'cancel' the contract. The courts recognize that each and every party that signed the contract is responsible for payment of the contract. What is frustrating is that the divorce attorney's do not do a good job of explaining the continuing responsibility's after the divorce. The divorce only settles the marital estate. The property settlement agreement states where the assets and liabilities are to be placed. BUT the creditors are not party to the divorce and do not have to honor the property settlement agreement - and they never do. They go after everyone on the contract. It is basic contract law. This is why lenders get as many people on the loan as they can - so in the case of default they have recourse against each and every co-signer.

The only way out of the financing contract you signed with your now ex spouse is to refinance it while you are current in the debt. Your ex would have had to refinance it into his name alone. From your post it sounds like the car may have been repossessed. You and your ex are responsible for the payments even after the repossession. If you look at the contract you signed there is usually a paragraph stating that the parties are 'jointly and severely' responsible for the debt. That means either one can pay the entire debt or both. If you get stuck with the entire payment, the only recourse is to bring your ex to court to have him repay you 1/2 of the amount, or whatever amount the judge will reimburse you for based on the contract and the suit. The other thing you can do is speak to a bankruptcy attorney if your financial situation is too large to handle.

This is one more hurdle to handle in the wake of your divorce, but you can do it. Once the financial side is settled - each contract refinanced or otherwise paid, then you can never have to feel the effect of his creditors against you again.

Did you just make up these acronyms?

FDCA?

FDRA?

Did you mean FCRA? And FDCPA?

As far as the FCRA goes, you have the right to dispute anything on your credit report and have it removed.

As far as the FDCPA goes, that does not apply here as it ONLY applies to THIRD PARTY debt collectors, NOT any type of actual creditor.

It is unfortunate that you were a victim of abuse, but that is not relevant to the situation at hand with Santander.

As far as your credit goes, all you need to do is dispute the items with the credit bureaus and provide them with the court documents to prove you are not responsible. Done.

As far as the contract goes, you are legally responsible for any contract you sign, regardless of circumstances. Again, don't mix the legal issues. One thing has absolutely nothing to do with the other, legally.

I suggest you get some real counseling as it is obvious that you have serious mental and emotional issues that you need to deal with. Maybe some PTSD here? Deal with these issues first.
