Have receive multiple comments and complaints from individuals that have referred their clients to this franchisor that became franchisees that they have breached their agreements and not paid them, stop paying or not paid on time suggesting internal financial problems that could indicate problems in supporting their franchisees. Non-payment has continued even after multiple payment agreements have been re-written.
This has been supported by documented evidence that appears such agreements were in place and they simply disregarded stated terms and conditions. This would strongly suggests their willingness to not live up to their agreements.

An Agreement and Settlement Has Been Reached

I received a call from Tony Nelson, President of SHS, on Fri. Nov. 25 saying he wanted to resolve my commission issue immediately after I turned down Kameron Thornes offer to accept a deeply discounted amount with other unacceptable conditions. After a short negotiation he agreed to pay the principal balance due of $12,500 and in turn I waived the $1845 interest charges that had accrued based on him wire transferring this amount to me that same day. He did just that.
Additionally he requested I post to RipOffRepot.com that he had reached an agreement with me and the original commission amount owed had been satisfied, which I agreed to do. While he acknowledged he owed the interest in addition to the commission balance I thought it in the best interest of everyone that had advocated for me and supported this effort to accept the principal amount and move on with helping my franchise clients rather than acting as a collection agency. Thanks to all for this public forum to allow the facts of this issue to be stated and a favorable result sought.

How about you acknowledge the facts surrounding your lies and admit to what you really did and continue to do with franchise brokers like myself? You refused to pay my commission as a qualified broker when I presented you a franchisee in Sept. 2010 with a total and arrogant regard to an agreement in place obligating you to pay me within 3 days of collecting the franchise fee from my client. After many excuses and broken promises to pay me in a timely manner you admitted you could only pay me in installments over 6 months. You signed a promissory note which terms you dictated to me and within 30 days of doing so breached this second agreement with nonpayment. You threatened me and my reputation if I dared to discuss this matter with the broker community and other franchisors. Subsequently you signed a third agreement with new payment terms which was also breached for non-payment within 30 day and leaving me owed $12,500 plus interest charges of $1845 you agreed to pay me as off 11/30/2011. Your rebuttal suggests you have paid brokers in full and on time. You know this is a lie as others have come forward as victims just like me. Not paying me is more than "an inconvenience" as you state. It is theft, deceit, immoral and unethical. You were warned to change the language in this posting to reflect the facts as I have presented here but persist in spreading these lies to play on the sympathies of other brokers to continue to send you leads that they may well never be paid for. At least two franchise broker organizations have taken you out of their listing or sanctioned you to be "put on hold" until these disputes are remedied. Your suggestion that I and we are unprofessional in using the Internet to bring this issue to light is a joke. What you really mean is keeping this information secure will allow you to perpetuate more of these misdeeds without consequence to your business. Is that your definition of professionalism? It's time for you Mr. Nelson and Mr. Thorne to fix this or suffer the consequences due you.

SHS Franchising does not deny that we have outstanding commission owed. We regret that this is the case and we are working diligently to finally get this resolved. We are sorry for any inconvenience this has caused. Unfortunately, many industries including the Franchise industry are suffering from the worst recession since the Great Depression. Many people have lost their jobs and their homes and the country is suffering. The top priority for SHS Franchising is always our existing franchisees and our employees. Over the past 4 years, SHS Franchising has paid in excess of $1.1 million in commissions to Franchise Consultants. We will continue to pay Franchise Consultants on time. SHS Franchising values our relationships with the many consultants that we have worked with over the years and we look forward to working with them in the future.
In closing, SHS Franchising feels that airing this issue over the internet is really not the most productive or professional way to try and resolve it. Using the internet to embarrass individuals or companies is unprofessional and in the long run unproductive. Just because one has the ability to do so does not make it right.
