- I bought a Straight Talk phone online on 11-23-2011.

- It shipped on 11-25-2011.

- I received it on 11-29-2011 via FedEx. 

- I called them and canceled my service within an hour of activating it on 11-29-2011. I asked for a refund at that point as I was unable to use the service (which, in itself, was bad). They assured me that I would receive a refund within 30 days. The customer service representative was extremely rude despite my politeness. She was also inept and tried to claim that I had service for an entire month.

- They would not pay for return postage. 

- I e-mailed the next day to verify that I will receive a credit before I shipped the phone back. They did not respond to my e-mail for a long time. When they did reply, they refused verification and told me to call. I believe this is to avoid having a paper trail.

- I called and the customer service representative informed me that my credit request was "pending" and there was no way to say whether I would receive it or not. I was a bit taken aback that the first customer service representative had lied but there was nothing I could do.

- I returned the phone using FedEx with a tracking number on 12-01-2011. It arrived on 12-06-2011. 

- I received a full refund on 12-21-2011. 

- I received a charge to my card on 12-29-2011. Despite the fact that it is a no contract service and my account was canceled, they still bill monthly with "auto refill" since they have the credit card information. I will have to go through the entire process again and wait to receive a refund for this! 

It is a despicable business practice to continue charging someone after they have canceled their service. I have e-mails and audio recordings of the calls verifying that my account was canceled. They have a "no refund" policy for minutes as well, so it's difficult to get them to refund even if the charge is unauthorized. I may have to file a charge-back.

This is not how business works. You are legally entitled to a refund for services never rendered. Their, and every other company's, policy is to issue a refund for service that was never accessible to you. The fact that they do not put this information in their FAQ for the laymen has no bearing on its truth and legality. Their TOS simply states that you do not get a refund for service that you have used, however.

A script that runs billing on credit cards should be tied into the status of the account. I am very well versed in how auto-pay scripts work and I am familiar with the programming of such things. You are incorrect to assume that scripts all run in the background immune to external forces. Every other lawful company programs their script not to bill an inactive account.

You stated that you can't call them to cancel billing, then stated that you must call them to cancel billing by simply rewording it to "turn off".

Re-sellers are liable for the service they claim to offer.

once you buy a service card you own it, there is no cancelling it. If you did receive a refund on a service card you were VERY lucky. if you signed up for the auto pay you will be billed the next month until you cancel the auto pay option which has to be done over the phone separately. you are correct that there is no contract BUT the auto pay option is just a script that runs and buys you a new card when your service date arrives, it has no way to know if you even have a phone it just buys credit and assigns it to your ESN. you cant call ST and cancel service cause they dont supply the service, only the phone and sell you minutes. you need to call them and turn off auto pay option or you will be charged again.

i never use the auto pay option for that reason, my phone broke last month and i just never paid it and got a new one and bought new minutes for it. i still got the phone and can use it if i fix the battery and buy minutes for it.

straight talk is not a service, its a reseller of services which they have no control over.

i never had an issue even when my phone broke i just got a new one and bought new minutes for it.

that another reason i only buy monthly cause if your phone breaks your out of luck on the remaining minutes, they cannot be transferred cause they are assigned to your specific ESN.
