When I first met this company, one evening when they came to my door around dinner time, I believed i had signed a one year contract to pay 14.99 + tax a mth
for responsible energy, (ie low carbon emissons) with this company and when i went to cancel the contract with them they told me that I would have to pay a
cancellation fee for breaking the FIVE year contract and that if I could call back in three days to find out how much the fee was. When I called back I was shocked
to find out the penalty fee was $675. (Doing the math this is the amount of money they would have charged me over the last four years of this contract) I told them
that I could not afford this sort of money and that this was why I wanted to cancel in the first place. I was given to a manage by the name of "Frank" he told me that
it was standard policy but if i called back in a few days he would see what he could do. So when I called back of course "Frank" was unavailable and the
gentleman who I spoke with told me that the only way that they would be able to cancel my contract without penalty was if I would send them my 2009 Notice of
Assessment from CRA proving that I made under $10,000. I explained to the man that this was not only a ridiculous request but that it was also illegal since they
are not a lending institution or bank and therefore cannot ask for these documents. He then told me that it was company policy and that everyone else in my
position wouldnt be having an issue sending those papers to them. I politely told him once again that what he was doing was illegal and he insisted. I said I would
not be sending the documents, that I would be filing complaints and hung up.

Summitt is of the opinion that the customer's contract is valid. The customer was advised during their reaffirmation
verification call that this program was an environmental program administered by Summitt Energy. The customer was
also made aware that this program would be an additional charge of $14.99 per month for a term of 5 years. The
customer confirmed that they had a copy of the contract and brochure which outlines the terms and conditions of the
contract and agreed to the terms of the contract. If the customer wishes to cancel, exit fees would apply. If the
customer would like to be considered for cancellation under Summitt's low-income policy, Summitt would require the
customer to provide proof of income.

My Rebuttal:

I have never had a copy of said contract and did NOT confirm that I had a copy of something I didnt nor would I agree to
something that I did not have. I agreed to a one year contract with this company when they came to my door (which is why I called to cancel after a year). Not five years, I was not in a financial position to agree with anything more than one year
at the time of their arrival at my house. Not only that but this companys request for proof of income does not comply with
laws set out to protect the common citizen. The document they have requested (the notice of assessment) is only to be
used for goverment and lending agencies.

I just dont understand how companies think that they can make claims like this and it is alright when it is a lie. I would have never agreed to something I didnt have in my hands. No person in their right minds would.
