Triad is absolutely THE worst company I've ever had to deal with. We have had to endure the constant harassing phone calls when a payment was ONE day late, they have called my husband and I's workplace when they were told not to. But this isn't even our story.Ohh, it gets worse.

On September of 2005 we were down to our last payment with Triad. We were having trouble financially at the time so we made arrangements, we just wanted to be rid of these people for good. My husband called them and they wanted us to post date a check. Well let me tell you DO NOT EVER post date a check with these people. Atleast 3 times they have put payments through our bank WITHOUT our permission, thus costing us money because of NSF fees from our bank. My husband told them no that we would not post date a check because they could not be trusted, that we would pay them in a couple weeks. Well October 3, 2005 Triad put through a payment WITHOUT our permission for the remaining balance. Once again we had NSF fees from other checks not clearing as a result.

My husband called them told them about the fees and the person he talked to said they would talk to a supervisor, that they would take care of it. Approximately October 15 or 16 we received paperwork stating that our lien was satisfied dated October 11, 2005 with a cleared title.Last Wednesday April 5th 2006 Triad had someone come to my house and they REPOSSESSED my vehicle. I have a clear title and papers saying the lien was satisfied and I reported it stolen. Of course the police could do nothing because Triad said we still owed them money. We just payed them $1300 to get my car back because we had no other choice. IS THIS LEGAL??? How can they take a car that they signed the title over to us SEVEN months ago?? Someone please help us. These people NEED TO BE STOPPED!

The title alone proves ownership. The cops should not have correlated a civil issue (them saying the car was not paid for) to a criminal complaint (a car that you have a legal title for was stolen).

I have read elsewhere on this site the term "title recall." There is no such thing as a title being "recalled". Once a title is issued a previous owner has no claim in said property because they signed the previous title - under penalties of purjury that no further lein action exists.

But, here is the thing, hidden away in the 30 something pages of documents you most likely signed was a power of attorney, supposedly granting Triad the right to sign stuff on your behalf. perhaps under the schem of an odometer reading requirement or something. If you still have copies of all that stuff look for it. If there is one there, then what Triad can -legally- do is apply for a lost title, sign your name, then have it mailed to them, then sign your name again, then have it retitled to them - legally. If there is a power of attorney send their legal department a certified letter (return receipt) revoking all priviledges.

Also hidden away in all that paperwork was most likely a clause that states if you received a title in error, you agree to return said title.

If there is this clause then to be frank, any court will uphold Triads legal right to the property -if- they show the court the title was truly issued in error. The courts scope is limited to the contract itself, so its a black and white issue to them.

So, recalling a title is not legal per say, but, Triad skirts it by placing within their legal documents either waivers or agreements of compliance.

When in doubt, always seek legal advice.

More news on my dealings with Triad

Well I am just updating my story. Yesterday we made arrangements to pay the $1328 that they claim was still owed on the car that they repossesed. Had to jump through hoops to pay it...they said it must be Western Union money gram blah blah. So we pay it , and have to call back with a confirmation number and then they will release our car.

I called back and was literally on the phone for ONE HOUR and FORTY TWO minutes.The lady in the legal dept informed me that they had faxed the recovery place the clearance and we could get our car. So we call the recovery place the rest of the day....NO clearance from Triad.

So I called this morning , NO CLEARANCE from Triad. So we call Triad back and they 'claim' to have sent it and will send it again. So we get to the place that had our car and they say it will be another $181 to get our car back ....a $75 TRIAD redemption fee, a $25 holding TRIAD FEE , and some other fees which were TRIAD fees. But its funny because TINA the legal dept supervisor at Triad had told us Tuesday that the $1328 was a final payment and we would not have any other charges.

When we called Triad GLENDA from the legal dept told us that the recovery place was lying, that those were their fees not Triads. I have a itemized bill of all the fees that were charged to us to get our car from the recovery place and every charge was a TRIAD FEE. This company is dishonest and is out to screw the people it loans money to. This company MUST BE STOPPED !

Please we have to do something to prevent this stuff from happening to anyone else. I want information on a class action lawsuit or any other resources that I can get to make this company pay for what they are doing. This is America for God sakes , they cannot be allowed to stay in business. I will contact the media if I have to ...call Barbara Walters and put this on 20/20 , I don't care what I have to do but Triad will go down. Please anyone that can give me any info on where to start, contact me at this email address....
