I had went to Wal-Mart to get my oil changed, just as I had in the past and received no problems. Only this time the service technition had informed me that they didn't have an oil filter for the make of my vehicle in stock. Therefor, she informed me that she had drained and replaced the oil in my oil pan.
I had forgotten to replace my filter afterwards and about a week and a half after Wal-Mart had serviced my Kia Sportage I noticed that the rods in my engine had begun to knock. Immedietly once my father had informed me that the oil cap was not properly replaced and not tightened down, causing all the oil in my engine to blow out the top of my engine.
I then took my car back up to Wal-Mart to inform them that the person that had worked on my car had not properly relpaced the oil cap and caused my rods to start knocking from the lack of oil in the engine.
They took all my information and sent the claim into their insurance company, who they instructed that I take my car to a dealership the get their report on what had caused the damage. The dealership agreed that the lack of oil in the engine was caused from the oil coming from the top of the engine, and informed the insurance company of that.
Of course the claims agent tried to find any other reason why the damaged was caused: such as, he asked the service technition if the leak in the valve cover gasket caused it, which was informed that there was only a seepage in the gasket. Then the claims agent tried to say it was caused because of my neglect to change the oil filter within the 3 month suggested period, because it had been 7 months since the last change, the technition informed the agent that the neglect would not have caused damage to that severity.
The claims agent was still not satisfied and informed us that since there wasn't any physical proof of Wal-Mart's technition not properly replacing the oil cap, then the claim would not go through.
Although I believe that the person that worked on my car at Wal-Mart might not be a certified technition because when I had gone back up there that person was working on the floor and not in the Tire & Lube Center. I was not aware that service mechanics also worked as floaters on the sales floor!!!
