Burns Brothers Landscaping Took $2900.00 downpayment October 2013-never provided services Edwardsville Illinois

On October 4, 2013 Andy Burns from Burns Brothers Landscaping came to my house & gave me a bid for a new patio,  to redo the brick edging with new pavers, install new decorative rock everywhere the old rock remained (to match the other half of landscaping that already had new decorative rock).  He quoted me a price of $5800.00, told me it would be the end of November 2013, at the latest, before he could do the job. 

I agreed with those terms & signed the contract and paid him $2900.00 down for materials etc.  He did not do the job by the end of November & due to the harsh winter, I was trying to be reasonable & thought he would do the job early Spring 2014.  He never called me during this whole time. 

I called him at the end of March or beginning of April and left a message for him to please call me.  He never called, but on April 12, 2014, I happened to be at my sister's house when he returned her call.  I asked if I could speak with him.  At that time he told me he was finishing a retaining wall & that my job was next.  He said he would call on Monday to have the utilities marked and probably start my job later that week or the following week. 

Needless to say, it is July 19, 2014 and he has yet to even start my job.  I have called him 8 times,     only to have him keep assuring me he is coming out soon, giving me start dates and then never showing up. 

I asked for a refund and he stated he really didn't want to do that & promised me, yet again, that he would be out June 23 or he would refund my money.  After not showing up on June 23, he stated he didn't want to refund my money and to please give him 3 more work days.   He promised and guaranteed me that it would be finished by July 4.

Throughout, I have been allowing for bad weather (or I would have called him more often), I have been patient, reasonable and more than understanding.  On July 2, when he hadn't even started the job, I knew if wouldn't be done by July 4, so I have called twice to ask for a refund.  He doesn't answer the phone & hasn't called me back.

Andy Burns of Burns Brothers Landscaping has had $2900.00 of my money since October 4, 2013.  He has not done one bit of work at my house, nor will he refund my money.  The last two times I have tried to contact him, he hasn't answered the phone and to date, has not returned my calls as I asked him to do.
