Has anyone tried to replace an AT&T phone yet??? Even though I am contracted to AT&T (which is now Cingular) I cannot replace my cellphone unless I START A NEW CONTRACT with Cingular!. So, for the next year, unless of course i want a steep penalty, i am stuck with a phone that needs help and a contract that is worthless to me as i cannot get any of the service i paid for in this regard! Highway robbery indeed. Anyone interested in a class-action on this ripoff can count me in!

30 days yes, cancel within and no ETF...not neccesarilly

This is for the last response saying that you have 30 days to cancel the account and not have an ETF ( early termination Fee) that is true, BUT only if you reverse migrate back to former At&T wireless will you not have to pay an ETF you would just go back to your existing contract with at&t, if you cancel everything all together then you will have the ETF, because your breaking a contract on either side if you do that, which IN the contract is not acceptable.

If you chosse to mirgrate your line to Cingular and start a new contract 1 or 2yr and receive a phone then the contract damages with AT&T are wavied. You also have 30 days to try out the service and cancel with no fee if you return the equipment. Sorry you had such an awful exprience and I hope this helps you out.

Highway Robbery ?!? I don't see your point

I am sorry I don't see your point on the robbery that you are incurring. If you are in a contract with at&t then you can live out your existing contract. If, as I suspect, are having trouble with your phone and you want a replacement phone, for free as I suspect again, then what do you think. Cingular should just give you a phone for free and let you live out your existing contract with at&t? Cinguar would lose out on that deal and the last time I checked cingular was a profit company not Unicef.

If you do not want to renew your agreement with cingular and get a phone for free then you can purchase a phone outright and still have your existing contract with at&t.

If you have phone insurance on your at&t service (it is optional so I doubt you signed up for it) then you can have your phone repaired for a nominal charge. If you want your phone replaced and don't want to pay for a phone then just sign a new agreement with cingular. I just fail to see how this is a ripoff from cingular, or at&t for that matter....
