A COMPANY OF CRIMINALS - INVITATION HOMES Peddles you a "home" in a high crime area, mentions nothing, refuses to work with you and steals your deposit in full. No fairness here. Gilbert Arizona

Invitation Homes walked me through a home that was really nice on the inside.  It had all the bells and whistles we were looking for, and I asked "What's the catch?" -- It was only slightly cheaper than others in the market.  So I thought nothing of it.  The area we drove through looked decent, we did some research and there didn't seem to be anything bad about it at first, so we decided to move forward.  We had a tough time searching for a rental in a seller's market in 2015. 

So we jumped in with both feet.  We put down the deposit ($1,165) and signed the lease.  Upon further research that same night, I started seeing things I was very taken aback by.  It turns out, just down the street, a block away we are by the worst public housing projects I've ever seen.  We were new to the area, and had no clue.  There had been a string of violent crime and robberies in the area seemingly forever.  I sent them this email to try and explain my situation, asking if we could work out a refund, or even explore other homes with Invitation Homes.  After all, thus far they had not lifted a finger cleaning the place, rekeying or anything.  We had not gone too far down the rabbit hole.  Or so I thought...

I hope you are all having a great Christmas Eve (day) so far.  We had researched this place, and initially it looked like a decent area.  We drove through the neighborhood and what we saw seemed OK. Certainly our initial research did not create enough concern to overcome the powerful feeling of finding a nice place that fit our needs in a home.
  
That said I am having serious concerns about Trulia crime maps, and some of the other websites I stumbled on last night.  The blocks behind us, and directly adjacent to us are seemingly riddled with monthly violent crime (Assault with a deadly weapon), several sex offenders, and robberies multiple times a month.  As if that's not enough, our own neighborhood (00 Block of W. st.) has its own sex offender.  There have been over three or four burglaries on our street in the past month alone.
 
These are not mere "once-in-a-while" occurrences.  The police reports show a continual pattern, month in and month out as far back as the clock goes.  If you haven't already, please go do research yourself, look at the Google Maps street views: Inglewood St. north of 56 W. Ingram St. is riddled with abandoned, broken out windows, shady neighbors.  The duplexes exactly one block away, directly adjacent to us (On our same street - Ingram) is even worse.  Boarded up windows, trash and abandoned mattresses all over the yards, graffiti.  Inherently weeds sprout out of every crack and crevice. Quite clearly these are methamphetamine drug dens, as confirmed by the regular "Assault with a Deadly Weapon" police reports.  While unfortunate I stumbled on this subsequent to paying a $1,165 deposit, I also feel it is wholly the responsibility of my management company to inform me of high crime in a neighborhood.  Would you feel warm and fuzzies about moving your wife and kids into a place like this?
 
At this point, granting us back the deposit in full sounds like good business and a fair outcome. I would like to hear what you can do.  We already paid the $150 app fees. We would much prefer to renew our current lease and keep on looking.  At least we feel safe here.

  • I subsequently sent pictures, proof of the next door neighbors at this location: Busted out windows, trash, mattresses, graffiti, etc.
  • I also asked courteously if they would be willing to show us some other properties, and work with us to retool the deposit and go for another Invitation Homes home.
 
 
To which I received this reply: 

Hello,

 

Thank you for your message. I sincerely apologize, but unfortunately once the lease is signed and the deposit is paid, the deposit is non-refundable and non-transferable under any circumstances. As stated in the email that is sent along with the lease,  “Lease must be signed and deposit collected within 48 hours. Entire deposit is non-refundable in the event of a cancellation, once keys are received $300 of the deposit is a non-refundable administration fee. Move in date cannot be changed once deposit is paid.”

 

I wish that there was something I could do, but due to the Fair Housing Act, we are required to treat all of our tenants the same, and therefore are unable to make any exceptions. If you choose not to pay move-in funds and take possession of the home on Saturday, you would unfortunately be forfeiting your deposit. I would suggest this option if you are sure you do not want to move-in, as it is much more costly to break your lease once it begins.

TL;DR - Shady sales tactics -- they won't tell you the truth about a place.  A company unwilling to work with you in the event you find a fatal flaw in a home, even just a few hours later.  They exercise the federal Fair Housing Act to rob you of your entire deposit and refuse to help you, or treat you fairly at all.  A $1,165 lesson learned.  "INVITATION HOMES" - in business to take every red cent, whether or not it's fair and an ethical business practice.

Original Poster here... Invitation Homes FIXED the problem.  It seems that although a few local people were delivering a clear message "You will not get your deposit back", the issue got escalated.  It took a few days, but when people in management took a look and realized they could work with us, they called me and offered to switch the home with a high crime rate for another one.  

That is good, fair business... No rip offs here.  (Sorry guys.)  They ended up treating me right.  Therefore I'd like to redact and say "Thank you for taking a look and treating your customers fairly".  

People, please move along, nothing to see here.

It is appreciated, and Invitation Homes: I think the good karma will pay off.

 If you haven't tried this...ask if you can move into another property they may have in a more acceptable neighborhood.

 Jim - you can say that if you would like. We did research. There are scores of different websites. It was a decent area for the most part. We didn't check every single block adjacent and around the place until we discovered a high crime rate. For that reason I think it's fair to reconsider taking that whole deposit. We haven't touched the place. Come on... They spelled it out in cancellation. They disclosed the deposit was non refundable. But that doesn't make it right buddy, it was a single day. Put it back on the market and work with your customers here. Work with us to figure something out. They hadn't even re keyed or cleaned it yet. So what is that deposit for? Not even a partial refund? Legally RIDICULOUS!

Since you "researched" this deal so well, why is it their fault YOU didn't check out the area "a few blocks" away?  If your research was so good, why didn't you turn up the crime environment there?  Since YOU were the renter and YOU were the ulimate decision maker, why is it THEIR fault when YOU, the decision maker failed in YOUR OWN research?

 

NO RIPOFF HERE.  Just another complainer blaming someone else for THEIR OWN mistakes!
