I consulted Lifeline Estate Services after hearing an advertisement on the radio. After the initial meeting they seemed very knowledgable and I requested they prepare a Trust for me and my mother. Approximately one year later my mother was ill and we needed to review the Trust. My mother had misplaced the documents. I called from the hospital and requested assistance from the company. They told me the only records they kept were the Power of Attorney for Health Care and Power of Attorney for Financial Decisions. They stated further that if we did not have the Trust Documents, we did not have a Trust.

We never give children of our clients copies of their parent(s) trust documents (while they are alive) unless we are provided a signed, notarized statement from two (2) physicians treating the client deeming them incompetent. Upon recieving said documents from the power of attorney named in said documents, along with proper identification, then and only then, will any information be released. No confidential information will ever be released unless this criteria is met. If the client(s) are deceased, no information will be released to the child or person inquiring unless they are the named succesor trustee(s) and can provide an original death certificate and proper identification.
With more then five thousand trusts drafted, we regularly get requests from children or an interested party demanding copies of these confidential documents. We consider these "fishing expeditions" by people that have not been furnished with these documents by our clients. It is entirely up to the client if they furnish these documents to their beneficiciaries or not.
If a client loses their documents, or is destroyed, we can print a copy for a minimal fee. Unfortunately this will not always work as some institutions will only accept an original. If the client wants or needs a signed trust with original signatures, we can do a restatement of the original document. That requires time as the trust and all ancilary douments (POA's, Certs Of Trust, pour over wills, etc.) have to be re-printed, re-dated, re-signed, re-witnessed and re-notarized. This would require the same amount of time as the original trust delivery. We still however only charge a fraction of the original trust price. We are a fee based company. We charge for the time incurred.
I don't believe anyone in my office would tell anyone they did not have a trust. If anything, they would quote a fee to do whatever work is requested.
The only person we can remember addressing this situation with was a child of an existing client. This child wrote a threatening letter from his prison cell in Carson City. That is where this complaint originated from and fits the time frame of this complaint. This person was convicted of child molestation and wanted us to do free work for his mom.
Whomever filed this complaint had the ability four years ago to have this situation rectified by requesting to speak with either myself or my wife, co-owner of Lifeline. We weren't even aware this complaint existed until a current client brought it to our attention. This complaint was not signed so we have no idea if this is a valid complaint or from a unhappy competitor.
