Mark sold a notebook PC with a broken base to me on ebay. His description mentioned scratches and normal use flaws but not the broken chassis. He refused return or any other compromise.

I appreciate the goal of ripoffreport.com to report situations in which someone has, in fact, been ripped off.
However, Gerald is not one of those people. The laptop that he was sold did NOT have a broken base. The laptop was advertised in good working condition with normal wear and tear, and that is exactly the item he received. It is honestly my belief that Gerald had a case of "buyer's remorse" and simply wanted a refund of the money after deciding he should have not spent money on a laptop with the holidays so close.
His first step was filing a non-receipt claim with Paypal. As he did, of course, receive the item... they immediately dismissed his claim. Next, he filed a claim of non-receipt with ebay. Again, dismissed. Finally, he filed a complaint along the lines of the item being misrepresented. After follow up, Ebay again denied his third attempt at recovering money for an unsubstantiated claim. The "crack" in the base that he refers to was merely a chip in the paint. Used item. Good condition. Some small cosmetic flaws.
I am not a power seller for ebay. I don't run a store, and am merely an individual who utilizes ebay on occasion to buy or sell personal items. However, of the 41 transactions I've made on ebay from buying and selling, his is the only negative feedback I've received. Around the same time as his claim against me, he also threatened action against another ebayer for a semi-high-ticket item. That ebayer DID refund him his money in order to avoid the hassles of Gerald's false claims. I stood behind the product I sold, but was not willing to eat all the seller, paypal, and shipping fees just because Gerald may have overextended his finances around the holidays.
I debated back and forth with him through ebay about this situation, and they agreed that the item he received was not misrepresented or damaged. I do not want to debate it again here, but when I merely decided one night to put my name in google and found it attached to a complaint on ripoffreport.com, I felt I needed to at least tell the story as it happened.
