I contacted Miles Shumilak (owner/editor) of  The LIST Magazine about possibly featuring my band on his website, we spoke on the phone and he agreed it would be a great idea. There was no mention of cost at all.

After we filled out interview questions, emailed back and forth about promotion details, and submitted photos, he requested payment to "cover operations costs" of posting our info. Since we'd gotten that far, I simply paid it through PayPal.

Weeks went by and nothing went up on the website. I emailed to follow up, to which he said they were incredibly busy and not to worry, the feature would be posted soon. I followed up several weeks later. No response.

Months later, he has still never responded to any communications. And of course, no feature was ever posted. 

It has been brought to my attention that Miles has run this scam on other musicians as well.

To any bands out there looking for good promotion partners, DO NOT work with Miles Shumilak or The List. He is running a scam to take your money and give nothing in return.

This is Miles Shumilak. I need to take responsibility for these old complaints about The LIST Magazine. I don't expect to win everyone's heart over but the least I can do is explain ...

 
The LIST was a print mag I created in my twenties, my first attempt at running a business (with zero training or experience). At that point I had been in a band for ten years, eventually sponsored by Lamborghini and touring the country, good times but still a starving artist. Intrigued by entertainment media and entrepreneurship, I took the leap and tried running my own mag. For years I made no money, chasing advertisers etc.. Eventually I had an 'aha' moment and realized I could offer micro-ads to indie artists like myself, and build a national promotional network that we would all benefit from. It was a ton of work to communicate with hundreds of bands, but it felt good to support musicians and $25 seemed extremely reasonable. 
 
The PROBLEM is that I was extremely naive about the workload I was committing to for such a cheap price. It quickly became overwhelming to edit so much content for so many bands who were barely paying anything. I couldn't keep up and people started getting pissed, understandably on their part. What no one realizes is that 95% of my bands were happy and successfully taken care of, but it became a massive business and I got way behind schedule, hence these angry comments. I DEFINITELY f**** up, but my goal was never to 'scam' people. 
 
CONSIDER THIS: if I was trying to to be shady, I certainly wouldn't have friended everyone on facebook, shared my personal phone number, email, and life story with all these artists ... so they could easily put me on blast and ruin my reputation. While some of you got left hanging for $25, look at the the damage I've done to my name. It's extremely embarrassing, I'm deeply ashamed, but now I have to deal with it. At this point presently, I've already resolved and/or refunded most of these complaints, but unfortunately the internet is not conducive to people making positive comments, as anyone who's been on youtube can attest. Tempers and words get out of control very quickly when someone is sitting safely home alone on their laptop. 
 
Bottom line is I bit off way more than I could chew at that point in my life, I got way overwhelmed, and The LIST failed. I was just a broke ambitious band guy who had a good idea that worked way too well and too fast. I'm GENUINELY SORRY, obviously I lost in the end and it'll take years (or forever) for me to fix my reputation. My friends in 'real life' love me, I'm a positive and intelligent person who made some stupid mistakes. I've learned from them and am now successfully supporting artists around the world. If you've never bit off more than you can chew ... you're not hungry enough.

I have been trying to get some sort of resolution out of Miles since Sept 25th 2011, when I paypalled him $25. For a few weeks prior to that we'd talked via email about me being featured on The List. He'd sent me a list of Interview Questions that I promptly replied to, and then after a few more emails he'd said that I needed to pay him the money before I would be published. When I paid, I received this email from him:

"Cool thanks man, just helps with operation costs so we aren't cluttered with lame ads. Our readers and artists are all happier this way. Just let me know when you're ready to move forward so we can put you in the schedule, glad to have you on the team!

You don't need an account, the request has instructions for a regular card, works great for everyone we work with.

After two months had gone by and still no word from him, I began emailing him again. Then I received this email on 11.30.11: 

"Hey man you guys are all done! My editor will send everything to you ..."

Needless to say, I never got anything from an editor... or Miles for that matter.

I sent many more emails to Miles, all of which have been ignored.

My last email to him was on 2.16.12, basically stating that I now understood just how ripped off I was. Never heard back from him. He blocked me on facebook and did not refund my money back as I had requested in the 2.16.12 email to him.

Very disappointed... and his flippant response above, that it was only $25 is pretty rude.

Issue Resolved

This miss-communication has been successfully resolved and is in the process of being removed. The author of this complaint, Chris Orsi, originally didn't receive the completed feature on his band, Lipstick and Cigarettes. Once this was brought to my attention I made sure to get it to him, and now everyone is happy.

"Hey Miles, thanks so much for coming through for us. You really went all out on this. It really means a lot! I contacted Ripoff Report and put in a request to remove the posting. I'll keep you updated when its gone. I'm sorry things had gotten so complicated, but everything is cool now."

Total lie. I contacted Miles several times via email for the past 6 months and every email was ignored.

I contacted him on Facebook and he blocked me. Is that good customer service? He knows I was reaching out to him if he made an effort to block me, but naturally no response about getting a refund.

I then reported him to the BBB, FTC, and California Department of Justice. He has also ignored all attempts to resolve through them as well.

It's amazing he can take the time to respond to this, but not respond to an email I sent several months ago.

I have also been in contact with two other bands he did the same exact thing to. So, this is not just some random miscommunication, it is clearly a scam. 

Refund my money, Miles. You know who I am and you have all my emails.

What's going on guys? Must have been a mistake or the link didn't get to you. Gimme your band name and I'll post it right here ... Don't stress! It's only a $25 publishing fee, it can be refunded pretty easily. Sorry for the miscommunication, I'm buried in emails. =)
