This company has called my cell phone and the home phone of my parents. My father is disabled and I assist in his care. The company has called me as many as 15 times in one day. They say that they represent a client that I owe $6244.84 on a vehicle that was repossed in 2/2000. I am aware of the statue of limitations laws for my state and infromed the man of this however he continued to harass and threaten to have my wages garnished until the debt was settled.I have recently stopped answering my cell phone when I see their number however they just call my parents phone. What can I do legally to stop this?

#1 Consumer Suggestion

In lieu of paying the debt. . .

AUTHOR: Don - (U.S.A.)

POSTED: Monday, August 13, 2007

I lieu of paying the debt, you have a few options. First, you can send a letter saying to cease all calls to any specific number or all numbers. Sample letters can be found throughout the internet.

Second, answer the phone once. A Collection agency can continue to call throughout the day as they are only limited to one contact per day. If they leave no message, and do not speak to you, they have not had contact and can continue to call.

Just making a point for arguement. Just becuase the statute of limitations has expired does not mean that they can not make collection attempts unless you are in Wisonsin and Alabama. It means that they can not sue you, and can not threaten to sue you. Why should you not have to pay for something that is legitimate (at least you did not mention any sort of dispute) regardless of whether it is old or not? If you loaned $6244.84 to someone, would you still want to be paid back even though it is after 7 years? Just trying to give the other side.
