RE: Driveway repair

Dear Mr. Heap

In April 2005 I had my driveway paved by Driveways by Heap.  Meredith, from your company, measured the driveway as 52 x 13 and gave me an estimate of $1800. 

While doing the job, your employees ran out of material, stating that the driveway was actually 82 x 13.  I was told it would cost an extra $200 to complete the job and I paid it. 

After the driveway was paved, there were puddles forming in the driveway.  I called repeatedly.  I know that your company came out twice to try to fix them unsuccessfully.

There were still puddles.  On August 26th ( I wrote it down on my calendar), you called me at home.  You asked me to wait until spring of 2006.  You said that you would have the driveway sealed at your cost to try to alleviate some of the puddles.  A neighbor of mine was visiting at the time and heard my side of the conversation and of course we talked about it after I hung up.

In April of 2006 I began repeatedly calling your company and leaving messages about my concerns with your answering service.  You have not returned a single message that I have left.  

I saved old messages on my answering machine from 2005. One message is from Meredith in which she states that she is aware of my situation and that the guys have been out there a couple of times and tried to relieve the puddles.  The intention is to go over with another layer and to take care of it for me.  I have another message fromWanda, also from Driveways by Heap, saying that she sat down with the owner, Robert and within two weeks I should have a date that it will be taken care of.

Since you have not answered my phone calls, I have called 2 other companies to get estimates to fix the puddles.  They say the section will have to be torn up and redone. 

To get rid of the puddles will be $600.  These same companies say the sealing job is another $250.  Both companies said the sealing the driveway would not get rid of puddles.

I would appreciate you responding to my letter within ten days of receipt. If I do not hear from you after that time I will have to seek further actions.

Driveways by Heap has no customer by the name of "D" in Whitman Ma who had any issue with our driveways. This is a simple case of slander and our lawyer has been contacted.

We demand the right to view proof that "D" has a legitimate complaint.

We demand this slanderous accusation be either proved or removed immediately.

We pride ourselves on our superior reputation and commitment to customer service and will not allow anyone to lay false claim against us.
