I am looking for other parties who have had misleading and deceptive transactions with TriBeca lending and Franklin Credit management. Also, I understand that there are federal lawsuits pending. I need any information and perhaps attorney names involved in suit.  I am a Westchester County, New York resident.

Franklin Credit Management Corp

We had a 2nd mortgage through Franklin Credit Mgmt (they bought the 2nd, we did not choose to utilize their services).  Due to an unexpected move to another state, we first rented out our house, then placed it on the market. 

Because of the market we were forced to sell short.  Franklin wanted $5k and they'd "forgive" the remaining amount.  The holder of the first would only allow Franklin $1k, therefore Franklin agreed to a note at a slightly lower interest rate.

The sale went through, however Franklin did not adjust their billing, and we fell behind waiting for them to adjust the billing.  Letters were sent, and they did not respond.

We finally worked an agreement to bring the account current, then began regular payments. 

Last summer while reviewing our credit to buy another house we found that Franklin was not reporting us as paying on time, and additionally had our loan listed as a "mortgage", which it is no longer.

We sent letters to all 3 credit bureau's and received confirmation that the changes were made.  In September of 2009 they finally started billing us correctly, according the their own agreement.

A couple of weeks ago the bank we're working with pulled our credit report and alas, Franklin was reporting as late every month in 2009 from January through September.  Additionally they were reporting us as having a residential mortgage. 

We compiled a letter to them, and enclosed copies of all statements and cancelled checks.  The letter was mailed certified mail to a specific person (I called to find out who to address the letter to).

Once we had confirmation they had received our letter, I began calling every day and leaving messages.  I was finally able to get ahold of that person, and she has promised the reporting errors will be corrected by the end of next week and that she will be forwarding the letter to us.

A word of advice - if you are in a similar situation, you will be wanting to improve your credit over time.  Keep a close eye on how Franklin reports your account to the credit bureau's.  Hopefully we'll have this resolved soon.  The key is persistence, and keep very good notes on who you speak with, when you speak with them and what they say.  It's to your benefit - only you can keep your credit in check.

I DID SOME RESEARCH AND FOUND WHAT I THOUGHT TO BE A SUIT FILED BY THE FTC AGAINST FRANKLIN / TRIBECA. UNFORTUNATELY IT WAS A DIFFERENT COMPANY ( SAME NAME ) MANY YEARS AGO. I DID SPEAK TO THE ATTY. THAT WAS INVOLVED. HIS ADVICE WAS TO GO TO THEIR SITE AND FILE A COMPLAINT WITH THEM AS WELL. THEY DO HAVE A COMPLAINT LINE BUT, YOU MAY NOT BE ABLE TO GO INTO AS MUCH DETAIL AS YOU WOULD BY FILING IT IN WRITING AS WE DID HERE. WITH YOUR SITUATION YOU MAY GET SOME ANSWERS TOO.

LET GET THIS SHOW GOING.... !!!!!

Mislead, lied to, inhibited our refinance by Franklin Credit/Tribecca Lending

Our saga with Franklin credit  started in april - may of 2008. As we found ourselves having a diffocult time keeping up with the adjustable rate mortgage @ 13 % and a small second outgoing payments totaled almost 4000.00 monthly. This wasn't a problem until funds from an auto accident were depleated. However prior to it getting out of control we inquired with 2 seperate banks, explained our situation, and because we had so much equity in our home we sat pretty well with the loan to value ratio.

It was at that time that things began to go side ways with the people at Franklin credit. As you stated you can never get anyone on the phone, if you do your transferred around to a bagillion different people who all say different things and claim to have the authority to do what it is your asking of them. Only to find out that they don't.

After approval through both Lenders, a "pay off request" was sent on a daily basis from both banks, the title company, and ourselves. This is a process that takes at most 15 minutes. Excuses we were given, "we haven't recieved the request", on every single attempt. After a month and a half we and the other parties continued to try and get this information.

A week or so later it was brought to our attention by one of the lenders that they had filed foreclosure proceedings with the County in which we live. This absolutelt fried us..... They sat on everything putting it off until they could start down the road to ruining our lives.

Yet the Lenders were still willing to work with us and we did try to negotiate with Franklin to get the Legal fees and some interest waived to make our loan work.

Then everything fell apart with the two Lenders. Franklin insisted that we could have a loan modification, with a Medical hardship letter which we did. Mind you I worked when I wasn't supposed to, or shouldn't have. As an Outside Sales Account exec. the driving of 800 miles a week was to my detrement. I have exstensive experience in the Beauty field from Hair, Make-up, Skin care, Retail, and Training.

On one occasion with one particular associate in the loss mitigation dept. we were told that if we sent them 25,000.00 they would restructure our loan..... If we had 25K just lying around I really don't think we would have had any issues.

After that they gave me a senario, e.g. of how the restructuring of our loan would play out. Now they said a good faith payment of 2700.00 would start us in the "program" mentioned in the previous post. It was just a senario..... Next thing I know I'm getting a call from my Husband that he went to use the debit card and it had been declined. Since our checking information was on file they took it upon themselves to TAKE 2700.00 unauthorized out of our checking leaving our account over drawn. It took days to reach someone. To no avail, nothing was resolved.

On yet another day I recieved a phone call from someone there who said, and it was quite a lengthy conversation regarding deferrment, interest changes, house payment amount. And all this for a mere 900.00 good faith payment and once they recieved that they would draw up the new contract. We shortly there after got a letter stating that we had not followed the terms of our agreement so everything was off the table and again they would not return the additional 900.00 as they said they applied it to the legal fees. The contract in question was never drawn up or recieved so as far as the terms of our agreement ????

Oh my G_ _, With my health issues and another surgery planned I just couldn't handle the stress anymore and turned all dealings with them to my Husband, My Brother (who is a V.P. with a community Bank) and my Father. Surely between the three of them they would be able to get this sorted out.

Finally, there was an agreement made. We had the Interest amount, the payment amount, and when our first payment would be due. Pending..... proof of homeowners insurance. This needed to be faxed ASAP, we had approximatly 3-4 days to get it to them, not an issue. I faxed it that day and I also called all parties to make sure it had been recieved and it in fact was. I was asked verbaly what the balance for the year was and I had our agent fax them as well.

July 23 2009, 3:30 PST we recieved a phone call from the person who handled the modification. ( That May I had emergency surgery to fix a Cerebral Aneurysm on the Carodid Artery ) I had the go ahead to return to work just not Outside Sales any longer. Which was fine with all my contacts I had 5 offers on the table, it was which one would be in the best interest of my health. I have to add that on top of working I recieve a check once a month from my car accident, which is as much as most peoples regular pay. During that phone call I could absolutly NOT believe what I was hearing !!!!!! They chose to decline the modification, based on my Brain Surgery and their thoughts as far as Me returning back to work.

I never at any point said, eluded to, or other that I would not be returning to work. I had been off for a short time in the grand scheme of things, and I was more than ready to return to work. I unlike the majority of people in the work force LOVE what I do. I am a certified Make-up Artist, My track record for Sales is exemplary, I also coach Girls Golf, and prior to the car accident was getting certified to teach Women and Children, I am a Free lance Artist from interior painting walls, floors, area floor clothes, Murals and also Faces for Weddings, Photo shoots, Runway shows, Editorial work and Television ALL which I am very pasionate about. And to have them discriminate against me for a Medical hick-up was deplorable.

The icing on the cake.... During that phone call if it wasn't shocking enough, they informed us that the auction date had been accelerated and was at 9:00 A.M. the very next morning. Panic set in, made so many phone calls to Franklin, as I now had the CFO's direct number and E-mail although no response from anyone. They went as far to tell my Husband that a Homeowner has the right to request 1 continuance and we could do that at the Auction. My Husband went.... with in an hour he called me unable to speek..... This was our "Home" not just a house. We raised our 4 boy's there, had it remodeled for my in-laws during their time of sickness until their passing. It was all so surreal. We haven't always had everything, we worked for everything we had, just to have it yanked out from beneath us, and to be singled out as a "dis-abled" person and to have them blatantly do so with no fear of reprocussion.

I imediatly called our Homeowners Ins Agent to get copies of all they sent to Franklin, had to tell them what had happened while bawling on the phone feeling dejected, humilated, among other things.

About a week later I got a call from our Insurance Agent and he said he was confused and was hoping we had everything work out because he had recieved a check from Franklin for the rest of the years premium for the homeowners insurance. To us this speaks loudly, they did infact approve our modification, everything which was asked of us was followed through on, however here we sit..... with nothing.
