MBNA Credit Card In May 2005 MBNA called my wife's father's house and left a message for her credit card debt, I called them back and they fraudulently put her debt on my credit report. ripoff Dallas Texas

In May 2005 MBNA called my wife's father's house and left a message for her credit card debt. I called them back to get their mailing address and amount, and they fraudulently put her debt on my credit report because I am her husband. I never gave them or even mentioned my SSN. Who should I contact?

card and I didn't think of making it a joint account until after it was approved. I asked if it could be reported in my name as well or if it could be turned into a joint account (my score is higher than his so I didn't see a problem) but they told me the only way to do it would be to close the account and start over. However, I seem to remember back in the late 70's and early 80's credit card companies would report it in both names even if it wasn't a joint account since we're in a community property state.

Wait a minuite

My name is Tom -i have been a collection and credit professional for 16 years. Lets just wait a minuite here.

Just because u are married does NOT mean you have one joint credit rating or bureau. The only loophole is that some states are considered 'homestead' states whereas all debt and assets of your wife are yours as well. Check with a commercial attorny to see if this applies to you.

However, it is dubious that this debt is yours unless u co signed as a co app on it. It should be under her credit alone. Married couples have seperate credit bureaus and scores.

p.s. also contact the credit bureau and ask them what the statues are , and consult the FCRA which is the fair debt reporting act. Also consult the FDCPA which again is a federal statute regarding debt collection.

However, if your wife took out the credit card after you were married, there is not a lot you can do, especially in a community property state. Her debt is your debt, Your money is her money.

I went through the same thing years ago, when my former husband defaulted on a car loan. Problem with that was that he took out the loan four years after our divorce, but I had to jump through hoops to get it off my credit.
