They told me they had 165,000 subscribers when I approached them to be a reseller. I found out later he had lied and there was in fact only an average of 45,000 subscribers per month. I would never have paid the $500 to be a reseller if I had known this. I would have tried to sell for them if the $500 was waived. I told him I had a few dozen prospects in the USA to sell to and given their much smaller number of actual monthly subscribers this made selling to them much harder. He has refused to pay me back the $500.

I just found this rebuttal and am concerned why this site didn't advise me there was a reply to my complaint. I stand by my statement made originally.

What are they saying isn't true? I have saved the emails from Navneet and his designer, Christina. I can prove that he signed off on the original information piece stating there was 165,000 subscribers and then about 2 months later their information pdf says they had grown to 200,000 subscribers. Yet he has admitted to me that there was only 45,000 actual subscribers per month on average back then. I don't know if the number of subscribers has grown or gotten smaller since April 7th 2010. I have proof I warned him to make it clear that the 200,000 was downloads of the application and not actual regular users or subscribers as the term in typically understood by the regular business community.

Calen Saress approached us in January 2010 to become a reseller our our service in Canada.  He asked us about our users in Canada and we told him we had ZERO users in Canada. He asked us about US users as well. We told him we had 165000 downloads in the USA.  At that time neither him nor us dove deeper into the numbers to understand what that meant and we believe there was  communication gap between the two parties.


Calen found the opportunity to sell the service in Canada to be lucrative, but since we had ZERO users in Canada, he negotiated an additional 10% in revenue share to be able to pay for SEO and other efforts in Canada to grow the user numbers in Canada.

Calen also wanted us to provide a different billing model for customers in  Canadian market. So we invested over $5000.00 building that model in order to support him and help him sell in Canada. According  to the agreement we executed with Calen, we would charge him $500 one time non refundable partner setup fee and a $80.00 per month fee which will be waived in any month where the monthly revenue was above a certain threshold. Calen never sold anything.  We waived the monthly minimum fee for the first couple of months in order to get him started.

As Calen was struggling to sell in Canada he switched to sell in US markets. So in March 2010, he called us up to get more clarity in our numbers for US market. At that time, we had a detailed discussion on the number of users and at that time it was clear to him that the number of total downloads was not the number of actual monthly users. We agreed that it was a communication gap and difference in understanding. 

In April and May, we billed him the minimum monthly fees of $80.00 as per the contract but issued him the refunds when he requested us to do so.  But we made it clear that as of June 1, 2010, we will not be refunding the monthly minimum fees. He decided to terminate the partnership and ask us for refund of his initial setup fee or  he would report us to BBB and the likes.

We decided not to be blackmailed as we have been fair partners as well as have provided the necessary tools and ongoing support for him to be successful.
