Yes, while waiting for the HOA approval and City of Allen permit, he did install a flower bed in the front yard.  What he didn't include was the fact that because this was outside the contract, I paid him an extra $900.00 to complete the work.  By the way, according City of Allen, no Building Permit was ever requested for my address.

  Yes, another company came out and poured the patio and built the roof.  He didn't mention that I signed a separate contract with the second company and paid a separate fee for the work performed.

MOST OF SHAWN'S rebuttal is untrue and misleading.  Yes, his crew did landscaping in the front and back while we waited for the HOA approval.  However, he failed to mention that I paid him $900.00 for that job in addition to the $9000 I put down for him to build a deck, roof, and a waterfall.  Yes, he did send someone else out to pour the deck and build the roof. However, I paid that guy and the electrician $25,000 to do the job.  

Shawn is a complete lier.  He told me he closed his business, and is working for someone else.  However, since I submitted my RIPOFF REPORT, I have been contacted by 4 other people who SHAWN took money from and never finished the job.  He did pay me $400 last Novenber, but hasn't paid anything since.  He had about 15 judgments against him before I got my judgment.  The police won't do anything and the court can't do anythng.  His house is in his wife's name.

Shawn, has refused to refund $8,000.00 for work not completed, so I filed suit in Small Claims Court for $8,000 plus $106.00 court costs plus $350.00 for Private Detective. Since Shawn did not appear in court, I was awarded a summary judgment. Another party also received a summary against Shawn in the same court session.

The rebuttal by SHAWN BYRNE was submitted on JUNE 22.  Ive waited over four weeks to respond in order to give him every opportunity to make a settlement.  He did contact me by text, and set up a date and time to meet me three times, but then he never showed up.  His rebuttal is basically true, but he left out a few things.   While waiting for the HOA and city permits, his crew did install a flowerbed in front, and planted some trees in the back yard.  This was outside contract, and I paid an additional $965.00 for this work.  Its also true that Shawn sent out another contractor to install a stamped concrete deck.  However, I had to pay the new contractor $10,550 for the new deck, and $9,652 for the roof.

Shawn owes me $9,000.00 less the cost of installing five beams, and building some forms.  Its also going to cost me a little over $100.00 to have someone haul off Shawns wheelbarrow with bags of cement which have broken open.  I asked him several time to come get his materials.  He promised to come, but then never showed up.  Do you notice a trend here?

I am Shawn Byrne and yes I did go into contract with Toni and Don. They did give me a down payment to start a project. I came out re landscaped their front yard for them with my crew that took 4 days.
When I went into contract with Don ( who is the nicest man in the world) we came to an agreement on work to be done . I got them everything to start their project and was set to start their job. Than Don told me we need to get his HOA approval first I said while you do that I will get the City of Allen permit. The permit was ready in about a week. I didnt release it from the City because I was waiting for the HOA approval.The HOA approval took over 5 weeks to get released.
The time the project was ready to be built we were on another project so we couldn't just leave one site to go to theres. I than had a concrete company go to there house to install the concrete that is needed to be installed before the project could be started.
The time the concrete company came out the Homeowner decided to contract them to install stamped concrete. They did that and the contractor installed Stamped concrete on the new back yard,
The week before that my crew came out to set forms for concrete and move and re run irrigation. The time we moved the irrigation Don Came out to have us increase the size of the concrete pad by 1500 square feet.
 My crew came out and did what he asked.
I could not get back to build the patio in the time fashion they needed. I do like Don and will make arrangements to pay him back,
