My fiance's bank account was frozen by this company because of credit card debt. He called and tried to make payment arrangements. He was told that he could make payments of 10% of his wages weekly. He agreed to do this and they told him to send a copy of his pay stub. They said they would make it a priority to get back to him after he faxed it. They never called him! After placing numerous calls to the company and leaving messages, he found out that they are garnishing his wages. They have not called him back at all.
He has filed a complaint with the attorney generals office. Is there anywhere else he can turn?

Filling a complaint is probably not going to get you anywhere. For them to attach his bank account(s), they would have already had to have a judgement against him. Since you are complaining about the Wage Garnishment and not the attaching of the bank account can we assume that this was a valid debt and suit. Once the garnishment is in place they should have release the freeze on the bank account.

Now, this case is the main reason you NEVER talk to any collector over the phone. Everything needs to be in writting, this way you have proof of what was said and there is no misunderstanding. From what they had him do and said it sounds as if that is that they were setting up a wage garnishment. Whether they used the actual words "Wage Garnishment" or not is another matter. Setting up a Garnishment is the only reason they would want him to fax a copy of his pay stub. Other than the embarasment factor with the employer they are getting their money as you said he agreed too. The only difference here is that they are taking it directly from his pay check rather than having him send it to them.

As a side note, feel lucky you live in New York, where they cap Garnishment at 10%. In other states they are allowed to take up to 25% of his paycheck.
