TVA entered into a contraft to provide video production servies for a product dvd plus to provide all b roll to client. On completion of projec and after taking $26,000 they are trying to demand fees for delays not of clients making but rather their own. Even though client is willing to pay final 13k as per contact they are demanding apprx 30k for the b roll which was promised as part of the original services. This is an attempt to hold client ransom after huges costs of setting up locations and testimonial interviews incurred by client.

TVA did a great job - dispute resolved.

Systems Paving would like to update its prior statement and acknowledge that there was a good faith dispute between SPI and TVA regarding the parties rights and obligations, and that dispute has now been resolved. In fact TVA did a great job of the video production.

With this matter resolved between the parties we would reccomend this comapny.

TVA agreed to honor the agreement to avoid litigation

In order to get our material from TVA we had to agree to remove our negative comments and state that
there was a dispuste which was resolved. TVA ended up agreeing to abide to the contract in order to avoid
litigation.

System Pavers failed to abide by schedule, failed to abide by schedule even after penalty initially waived, refused to pay penalty after failing to meet new schedule, failed to close when delivery offered with no penalty, spurned compromises that still would have waived all or a portion of penalty, insisted on additional terms that clearly were outside contract, all on a contract that was an unprofitable accommodation to a client in the context of what was assumed to be an ongoing relationship.
System Pavers signed a contract with TVA on April 1, 2010 to produce a corporate DVD for use by their sales reps. The only deliverable promised was a DVD master suitable for replication. Since they were a returning client and promised us that production of an infomercial would soon follow this new assignment we agreed to do their project with a minimal profit margin, with the condition that the client would provide locations, testimonials and  timely approvals of all elements of production; prompt payments; etc.

Their DVD production was scheduled to be completed by May 19, 2010 (seven weeks from commencement per contract). As a result of this clients constant delays by not having locations and testimonials , this seven week production turned into a seven month ordeal. On top of that, SP demanded items that were never a part of the contract.   
 
SP failed to provide timely approvals and delayed the shooting for months saying their multiple customers homes were not ready for a commercial shoot. Due to their constant delays, we had to reshuffle our other jobs several times to fit in their shooting schedules. We missed many job opportunities due to the fact that we had to block away our time to complete their job before we could pursue or take on other jobs.
 
After nearly three months of prolonged delays, we asked SP to honor the contract which calls for an unreasonable delay fee if project is delayed by client for more than three weeks. After much heated discussion, we agreed to waive the fee if client agreed to pay the fee without dispute if there were any more delays.
 
At month seven, we sent them notice of reassessed fees for the further delays.  Not only are they unwilling to pay this, they still havent paid the original balance---even though they told us in writing they love the DVD. The company owner Larry Green showed no interest in resolving the issues amicably but attacked us with rudeness and acted like a total bully. We offered to cut the fee in half.  That was rejected outright.  We offered to credit the delay fee (with 50% discount) towards the infomercial they promised us. That was also rejected. Larry refused to offer any concessions and instead demanded all of the footage (not just the finished / edited DVD).
 
We have worked so hard for their DVD production job for over seven months, which is the length of time a project costing many times more would have taken us. We would have been happy to even waive their late fees again without being asked, had they been slightly reasonable and pleasant. But we refuse to give our product and service free of charge to a client who does not maintain least bit of professionalism and threatens lawsuits unless he gets his way in every step. Already we made no profit in their project after our substantial overhead due to the constant delays. We really dont have desire to do business with this client ever again. We have maintained an A+ class level for our business with BBB for over twenty years and a Class 1 rating with DNB. We have over 200 case studies and references covering 30 industries. We will fight to protect our reputation from being harmed by a bully who takes no responsibility for his companys own breaches of contract.
